Planning Board meeting minutes for Thursday May 22, 2014
The meeting opened at 7:15 p.m.
Members present: Roger Tryon, Alan Salamon, Barry Karson, Stephen Enoch co-chair, Maggie Leonard co-chair.
The board read the minutes from 5-8-14. A correction was made to change the word “join “ to “joint” to read, “The joint meeting of the Planning Board and ZBA…” The word “proposed” was added to read, “…ZBA met to discuss proposed changes to the zoning bylaw.” The minutes were approved as amended.
The board discussed that each person needs to take a position on the changes proposed by the ZBA. Then we can vote on them as a board and move forward and either recommend or not.
The board discussed the ZBA opinion re: Nonconforming Uses, Structures and Lots. Salamon noted that the ZBA thinks that our zoning bylaws are at odds with current thinking based on case law. Leonard agreed to email the web links to the cases to each board member so that we may discuss them at the next meeting.
Salamon made a motion that we send a letter to the ZBA with the following points:
•We are responding to your comments.
•Please submit your proposed change to the Select Bd according to the statute.
The motion failed.
Karson made a motion to send a letter to the ZBA with the following points:
•Thanks for your input.
•We are moving forward and working on the issues.
• Please submit your proposed change to the Select Bd according to the statute.
The motion was seconded and approved with four in favor and one abstention.
The board agreed to proceed with working on a bylaw allowing for Accessory Dwelling Units. Leonard agreed to email the board a list that Salamon created for specific issues related to ADU’s (the list is in the March minutes 3-13-14).
Salamon motioned to adjourn, Karson seconded; the meeting was adjourned at 9:07 p.m.
