Planning Board minutes Thursday June 27, 2013

The board held a public hearing from 7:07–7:22 p.m. The hearing was recorded and minutes will be available.

Members present: Maggie Leonard, Alan Salamon, Larry Klein, Stephen Enoch, Roger Tryon (arrived 7:30 p.m.).

Members absent: Bridget Krans and Barry Karson.

The board discussed work on the floodplain bylaw. The board would like to meet with Dan Moriarty, a resident who lives on Lake Buel and who has lobbied for the passage of a floodplain bylaw. The board also wants to meet with the building commissioner to see what the possible ramifications of the floodplain bylaw would be to building and renovations around the lake. Leonard noted that the lakeshore district has high property values and is densely populated (relative to the rest of the town of Monterey) and that the Planning Board is being very careful to investigate the possible effect of a floodplain bylaw.

Alan Salamon has contacted Richard Zingarelli, MA DCR Flood Hazardous Management Program for his expertise. Each board member can come up with a list of questions and Alan will email them to Zingarelli.

Larry Klein noted that we have to be careful that any floodplain regulations are not in conflict with our current zoning bylaws, i.e. increasing height past 35’. If a homeowner must jack-up their home to comply with the FEMA flood insurance guidelines, and doing so increases the height above 35’—what then? Tryon stated that restrictions are constantly implemented and regulations are always changing. Salamon noted that increased heights might negatively impact abutters.

Enoch stated that since there are numerous FEMA requirements it may be best to require a special permit. Klein said he preferred not to require the special permit process for this because it is more time-consuming and costly for homeowners.

Regarding the solar power bylaw, the board requested that Leonard contact Mark Bobrowski and ask about which section to place the solar bylaw in the zoning bylaws. Specifically there are two sections, section 2.2 and section 8.1 and which is the most logical place for the zoning bylaw?

Enoch will not be here for the meeting on July 11, 2013.
