Monterey Planning Board Meeting Minutes: 12/22/2011
Members Present: Maggie Leonard; chair, Bridget Krans, Stephen Enoch and Barry Karson
Meeting to order: 7:15
- Pearl Realty ANR- Stephen felt that “approved to an acceptable standard” needed more quantification. Barry had a concern that weather the Planning Board had the authority to state that someone did not have the right to a building permit. Maggie stated that it is OK when it is in the planning stage and we put in in as conditions. Barry wondered how we can legislate that the road needs to be better when she already has a house on the property with the road as it is. Stephen explained that he felt that we cannot penalize Ms. Markus for something that already existed. Now they are trying to create a new lot so it is OK to enforce that they need to increase the standards. Stephen suggested the wording as: Lot 1 is not deemed a buildable lot until all roads leading to the access
of lot one meet the standards of a common driveway. Mike stated that if Shawn wanted to build on the entire lot he could just pull a permit. The board agreed that this may be the case but that is not what Shawn is doing. He is splitting the lot and therefore the road needs to be brought up to common driveway standards. Barry did not feel that the common driveway should be the standard of the road. He felt that is should be 20 as is such the size of the roads. Maggie suggested a traveled way of at least 20 feet and 2 feet shoulders on either side. Stephen felt that there were some drainage problems and maybe we should give them higher standards and then let them ask for variances. Maggie felt that we should not write something that we are not willing to enforce. Stephen’s concern was that if we just give a couple of dimensions that they need to meet then there might be other problems that they do not fix. Maggie said we cannot make it a subdivision road
because there are houses in the way. Suggested wording by the board: Lots 1 and 2 as shown hereon shall not be entitled to a building permit from the Town of Monterey, unless and until such time as West Road and Maple Street from Route 57 to a point at least 200 feet westerly of the Southeast corner of lot 1 shown hereon have been improved to a minimum width of 20 feet with 2 foot shoulders with sufficient drainage. Maggie is going to get in touch with Mike Parsons regarding a current statement that is on the plan regarding when subdivision became in effect in Monterey in 1974. It also states that the road was sufficient according to the opinion of the Planning Board. The board does not agree with what it says and wants to get it straightened out prior to signing off on anything. It is not relevant or appropriate for the current situation. Maggie will also get in touch with Mr. Parsons about the wording regarding the improvement of the road
that has been discussed. Barry questioned what authority we had to place restrictions on lot 2. Maggie stated that the way the plan is being drawn up is creating two new lots. Barry wondered why we can’t approve lot one and make to determination on lot 2. Maggie felt that by approving the plan lot 2 would have the board’s stamp of approval. Bridget pointed out that if we said lot 1 could not be built upon before improving the road then that may never be built on and as a result the road will not be improved and lot 2 could be sold and nothing ever done with the road. Barry felt uncomfortable with us imposing restrictions on lot 2. Maggie is going to cc town counsel and double check with Mike Parsons to make sure that there is no legal conflict regarding the wording.
