Planning Board meeting minutes 4/14/2011
Members Present: Maggie Leonard; chair, Larry Klein, Alan Solomon, Barry Karson ,Bridget Krans and Stephen Enoch (7:07)
Public Present: Gene Bounous (7:30)
Meeting to order: 7:00
  • Public Business: Camp Keswick and the company they are working with submitted a map of where they would like to place a cell tower. They inquired as to whether or not it was a site of historical interest. Maggie is going to call Matt Kinneman at Camp Keswick about looking at the proposed sight. Larry is going to call AT&T about getting information about the coverage and the location.
  • Minutes from 3-24-11: The minutes composed by Maggie from the 3-24-11 meeting were accepted as corrected. Bridget neglected to bring the minutes from 3-10-11. Although they were emailed to everyone she will bring them to the next meeting.
  • Annual Town Meeting: The annual town meeting is May 7th at 10:00 AM. The planning board needs to make a report at the informational town meeting on April 29th and also at the May 7th hearing. Maggie has agreed to make the report at each meeting. Stephen suggested that Maggie use the report she used for the public meeting. It was also discussed as to whether or not to discuss the health concerns that were brought before the board. Maggie felt that she would inform everyone of all the information that was brought before the board and make sure that we let everyone know that Maggie especially looked into it all. Alan inquired as to whether or not we were confident that we had a strong legal bylaw. The board felt strongly that we did. We had it reviewed by a BRPC attorney as well as our town counsel. Stephen brought up his concern that the discussion about the bylaw will get tabled at the town meeting. Stephen has spoken with Select board Chair Jon Sylbert who suggested that there may be some legal method of challenging that. Stephen and Bridget felt that it would make people more comfortable if it were a paper ballot. Barry did not feel this way. Maggie is going to look into how this works. Larry stated that if the bylaw was tabled at the town meeting then there may be a large possibility that the tower companies will go ahead with legal action. Mr. Bounous stated that he heard that was the case.
  • Gene Bounous: Mr. Bounous inquired as to if the bylaw passes then do we need to wait another six months until the attorney general approves the bylaw as well. Mr. Bounous was also concerned about what happens if the bylaw does not pass. Mr. Bounous wondered if there needed to be a separate town meeting for this bylaw.
  • New Telecommunication bylaw- Maggie spoke with town clerk Linda Thorpe. Linda is going to have the old bylaw printed out along with the new one for the town meeting. The board was concerned about the date of the bylaw that was on the town website. Everyone agreed on the most recent draft that was done in April.
  • Planning Board Members: Larry is running for the Planning Board for another five years. At this time we do not know of anyone that is interested in filling the empty spot. Alan stated that he felt guilty about being away over the winter. If we had two people Alan said he would not feel badly stepping down.
  • Reports from board members:  Maggie stated that she needs to get the agenda to the town clerk by a certain amount of time prior to the meeting. Maggie would like to standardize when she sends out the agenda to the board in order to receive feedback and get it to the town clerk on time. Maggie will get the agenda to the board members by Saturday prior to the Thursday meeting. If any board members have additions or suggestions they can be emailed to Maggie at this time. Stephen wondered where we are going to put our energies as a board next when we are finished with the bylaw. Stephen stated that he had an interest in working on accessory dwelling units in Monterey. Larry stated that we also do not have any thing in our bylaws about derelict buildings. Stephen said that the board of health can get involved in buildings that are deemed a health hazard.
  • Open Mail: The town of Tyrringham is holding a public hearing on a new wireless communications bylaw on Monday April 13th. The board noticed that the date on the letter was wrong. New Marlborough planning board is holding a public hearing on Saturday the 16th of April on proposed changes to their subdivision bylaw. The town of Great Barrington is holding a hearing on a two lot subdivision on Keno lane. The application for the town dog park was denied. The abutters to the property had a substantial case that they presented in writing. The BRPC minutes were also received.
