Planning Board Meeting Minutes for May 27th, 2010
Meeting to order: 7:07 PM.
Members Present: Maggie Leonard; co-chair, Steve Enoch, Alan Solomon, Larry Klein, Bridget Krans and Barry Karson (arrived at 8:25PM).
Public Present: Mike Parsons of Kelly Granger and Parsons Land Surveying
- Previous meeting minutes: approved as written
- Mike Parsons from Kelly Granger and Parson Land Surveying came to discuss the Stencil property on Hupi Road. Mr. Parsons is taking three non-conformities and making them conforming. The Stencils put up a garage that is too close to the set back. The abutter, Bula is going to convey the appropriate land to Stencil and Stencil to Bula and the result will be that all lots then will be of a conforming nature. The Planning Board unanimously agreed to approve the plan. Mr. Parsons submitted the appropriate fee.
- Non-conforming case law- Alan made the point that picking one part of the zoning bylaw and changing it does not make the most sense. It might be more appropriate to look at each separate bylaw. The board discussed whether or not there would be funds to have the bylaws rewritten or if the members of the board were qualified to do it. A member of the ZBA submitted information on a case law that suggests that if one thing is non conforming then nothing can be done on that lot or with the structures on the lot.
- Commonwealth Capital application- Maggie worked over the weekend on the grant. Maggie discovered that attachments were needed in order to complete the grant. As Maggie has been working on it she has discovered that the score for Monterey is possibly going to go down. Maggie will discuss this with Jon Sylbert. Alan is going to help answer the questions within the grant application regarding preserved land.
- Mail Opened- Florida Towers are asking the opinion of the board on what the historical impact would be if they were to construct a tower at 31 Main Road Monterey. The study is being done by Infinigy Engineering and Surveying. Monterey does not have any historic districts in town. Maggie is going to reply and explain that we currently have no historic bylaws that limit building.
- Litigation planning workshop from FEMA and the department of Conservation Recreation. Reducing and limiting property and life due to natural disasters. Any interested parties are welcome to attend.
- Berkshire Regional Planning meeting minutes were received.
- Stephen Enoch attended the Select board meeting on Monday and the Select board mentioned to Stephen that they would like to work with the Planning Board on ways to keep our downtown area vibrant. The Selectmen would like help with the revitalization of down town Monterey. The Planning Board expressed interest in brainstorming to come up with ideas.
