July 9th, 2009 Planning Board Meeting Minutes
Members present: Steve, Alan, Maggie, Cindy and Bridget
Public Present: Rob Ackroyd, David Hellman
Opened at 7:05
- Form c-2 will be filled out by the planning board
- The board reviewed the conditions placed on a few subdivisions in Lee and Lenox to compare to the subdivision the board is currently reviewing.
- The board will go over the notes and the plans and then take a vote to approve or disapprove the subdivision plan.
- The board reviewed all of the conditions
- The board will file form c-2 with the town clerk. When this is done it starts the 20 day appeal period. Then the board of health will sign and then the planning board will sign.
- The conditions discussed are as follows:
- David Hellman the attorney for Judy Bach will file a covenant or a performance bond.
- The lands owner must have the road completed and approved prior to selling any lots.
- Greenway will remain a private road. The board requested that be notated on the plan. It will be stated that it shall not become a public roadway.
- Record Declaration of trust of Greenway maintenance
- If a building permit was being applied for a structure other than a single family home for lot # 4 prior to approval section 7 C of town zoning bylaws must be met.
- Before a certificate of occupancy is granted an easement plan showing a meets and bounds description of all easements for driveways, drainage, utilities and septic systems will be required.
- Prior to construction on driveway or houses applicant must go back to Con Com for all appropriate permits.
- No responsibility for drainage retainage/retention shall fall on the town.
- The board made necessary changes to form C-2
- Mr. Hellman will be rewording waiver #4.
- The list of conditions was agreed upon by the board.
- The board voted to approve the subdivision plan with conditions as outlined and 7 waivers. Maggie made the motion and Alan seconded. It was unanimous.
- Cindy will type up all forms. The board will sign on July 23rd 2009 at 7:00 PM. They will then be submitted to Linda Thorpe.
- Previous meeting minutes were approved as amended.
- There was a special permit application for the Wilson McLaughlin house to change from residence to business use.
- Berkshire regional Planning needs a representative from the Planning Board to go to their meetings on the 3rd Thursday of every other month. Alan agreed and Maggie stated that she would be the alternate. Alan will be the delegate.
