MONTEREY BOARD OF HEALTH MEETING MINUTES

Date:  July 20, 2015
Present:  John Makuc, Roy Carwile, Robert Annelli and Peter Kolodziej
Also present: Craig Willis, Richard Nault and Peter Vallianos


The meeting began at 4pm

1.  The minutes from 7/6/15 were approved.
2.  Craig Willis of White Wolf T&E came in for the hearing regarding the violation of MGL Chapter 111 Section 31 and 31A and 310 CMR 15.500, 502(1)(3)(4)(7) (removing and transporting septage waste without a permit).  The Board felt that Craig should know a permit is needed to pump septage in any town.  The Board decided that Craig needed to apply for a permit for this year and pay for one for the previous year as well.
3.  Richard Nault and Peter Vallianos came in to discuss a 2 bedroom deed restriction that the Board of Health had him place on his property 17 years ago.  Richard now wants this removed as he would like to expand on his property.  The Board inquired as to what the future proposal is for the property.  It was noted that the septic is designed for 3 bedrooms.  The property currently has 2 bedrooms and another room that is a bedroom by definition only.  The only way the deed restriction can be removed is if the Board of Health agreed to release it; the Board believes it may have been because conventional systems were no longer allowed within 400ft of the lake and Mr. Nault was not willing to put in an alternative system.  Peter stated that if the property is going to be sold that a Title V inspection will be required to determine if the septic system is functioning properly and the Board wouldn’t have any issue releasing the deed restriction based on current Title V standards.
4.  Peter updated the Board on a violation letter that was sent to Kutsher’s Sports Academy with regards to 105 CMR 300, 320.(590.00), 435.00, 454 and .350/.355.
5.  Dog licenses: every dog is required to have a rabies vaccine.  Some older dogs or dogs with health issues are unable to get a rabies vaccine which prevents them from getting a license in the town unless the Board of Health exempts cases when appropriate.
6.  The BOH still has $2,700 available to spend from a mini-grant a few years ago; ideas for spending the funds for Board of Health purposes were dicussed.
