MONTEREY BOARD OF HEALTH MEETING MINUTES
Date: December 2, 2013
Present: John Makuc, Stephen Enoch, and Peter Kolodziej

The meeting began at 4pm
1. The minutes from 11/18/13 were approved.
2. Peter reported that he has received a complaint from Eric Montgomery regarding the outdoor wood furnace across the street which the neighbor voluntarily stopped using last year after several complaints. The Board of Health has not instructed the neighbor that they cannot use the furnace.
3. Stephen asked if the Board should create any regulations regarding e-cigarettes: Peter suggested waiting until more data is available from the Food & Drug Administration.
4. Millie Church was supposed to be present tonight to update the Board on the progress of the cleanup and the attorney that she has retained. She called stating she was having car troubles and that she had not yet chosen an attorney and the outside cleanup has been halted because of the weather. The Chief updated M. Noe on the claims of break-ins and confirmed that they have been called to the property but there weren’t any signs of anyone entering the home so it cannot be considered a break-in. The Chief did note that he did see the son taking a truck load to the dump last week. John has made several site visits including one today and noted that there are some bins of food and that it was far from being anywhere close to clean. Millie showed up at 4:25pm and stated that she has
sold 2 loads of furnishings from inside the house. She hopes to get more cleaned up outside this week since the weather is expected to be nicer. Stephen stated that since no one is currently living there and most of the animals are hibernating and the property isn’t currently a hazard to the neighbors should they take action at court or continue to allow the Board to make site visits while Millie continues her efforts; if the Board feels that it becomes a risk to anyone they will take action. The Board suggested that with regards to the alleged trespassers Millie should consider putting up no trespassing signs and a chain so that vehicles cannot access the property. Peter stated that legally the Board of Health is allowed to access a property for an inspection but they are not allowed to access the home without the owner’s permission. The Board will create an updated letter to the requirements to cleaning up the property.
5. Peter stated that it’s likely he will be subpoenaed regarding the housing issue that came up last year on New Marlboro Rd.
6. The Board will meet next on December 16th at 4pm.
