MONTEREY BOARD OF HEALTH MEETING MINUTES

Date:  January 11, 2010

The meeting began at 3:35pm
1.  The minutes from 12.7.09 were approved as written.
2.  Peter recapped for the Board his meeting with representatives of New England Keswick and the Building Inspector as well as Melissa Noe, secretary to both the Building Inspector and Board of Health.  Don Torrico has determined that New England Keswick’s yearly operations predate zoning (they have been operating on a yearly basis since the 1960’s) and therefore are grandfathered from having to apply for a special permit to run year round (which was previously not allowed under our bylaws).  Their current Certificate of Inspection is valid until June 30, 2010.  Peter approved their application for a Food Service Permit and informed them that they will need to apply for a hotel/motel/cabin yearly permit (the process and fees will be discussed during this meeting).  Keswick was also informed that any children’s camps that are not New England Keswick but will be leasing their facilities will need to apply for their own children’s camp permits if they will be operation for more than 4 consecutive days.  The camp will be providing the town with a calendar of camps and events they will be hosting; the Board requested that the number of staff and attendees for each event also be included in the summary.
3.  Peter Kolodziej noted that Camp Half Moon has completed installing their new well and this will allow them to be open longer.
4.  The Board discussed possible fees for the hotel/motel/cabin application/permit and determined that the fees would be as follows: Camps $200.00, Camps/hotels/motels/cabins $250.00 and Hotels/motels/cabins $250.00.
5.  The Board reviewed the ZBA special permit application for the Mandelbaum’s of 521 Main Rd.  David Hellman was concerned that the room called a “study” would be considered a bedroom by the Board of Health.  The septic is designed for 3 bedrooms and there are already 3 bedrooms.  The homeowner is willing to put a deed restriction on the property limiting it to 3 bedrooms.  The Board suggested that another Title V inspection might be appropriate since it has been over 2 years and a new structure is being built.  David suggested that a condition be set that it will have to be re-inspected prior to a c of o being issued by the building department, then if the system was found to not be in working order they would upgrade the system, but this would allow them to begin construction.  The Board also talked about taking the door out of the “study” thus making it not meet the bedroom definition (there also is not a closet) and then a deed restriction wouldn’t be necessary. The following opinion was issued to the ZBA:
a.  The Board reviewed the existing septic system that is designed for 3 bedrooms.  The Board stated that the door will need to be removed from the “study” so that it will no longer meet the Title V definition of a bedroom and eliminate the possibility of it being considered a 4 bedroom home.  The Board will also require that a Title V inspection be performed on the existing system prior to a Certificate of Occupancy being issued by the Building Inspector.
6.  The Accountant reminded the Board that they still have $509.80 left from their mini grant to spend.  The Board discussed items that might be needed.  Talk of an automated caller for emergencies and such like the school and Egremont use.  Purchasing a GPS was also discussed.  The Board could not come up with anything that was necessary to purchase right at this moment.
7.  There will be a free H1N1 clinic at the Monterey Firehouse on Monday, January 18th from 5-8pm.
8.  The next meeting will be Monday, February 1st at 3:30.
