MONTEREY BOARD OF HEALTH MEETING MINUTES
Date: March 9, 2009
Present: John Makuc, Stephen Enoch, Peter Kolodziej and Robert Annelli

The meeting began at 3:30pm
- The minutes from 2.23.09 were approved as written.
- Shaun Tucker and Mike Parsons gave a presentation to the Board of their proposed development at the top of West Rd. This will be a friendly 40B application which allows him to bypass several local bylaw and subdivision requirements providing a percentage of the homes in the development are designated affordable. There will be 16 single family homes on 16 parcels of land. The lots vary in size. Originally they were proposing individual septic systems and 1 well per 2 homes but Shaun is currently speaking with SK Design after having met with Peter Kolodziej and hearing his input. There aren’t any issues from a Title V perspective but there might possibly be one from the building code or DEP. Shaun mentioned that he is going for LEED Certification which is a “green certification”.
Houses will be built on site using local contractors. The houses will be 3 bedrooms and 2 baths and will not have full basements. Mike stated that they plan to upgrade West Rd. all the way up from Rt 57. There wouldn’t be any variances requested at this time for the septics or wells. The Board questioned the pumping frequency and if that would be enforced through an association or not. SK Design is working on a design for improvements to the road and storm water management. New power lines will be run. Robert Annelli noted that once you start adding in all these association fees the “affordable homes” lose their affordability. Shaun stated that if the project isn’t supported by the town boards and becomes adversarial, he won’t proceed. Robert Annelli asked what happens to the affordable property if it’s foreclosed on; Mike stated that the bank would have to sell it at the price in the
deed restriction. The Board stated they’d like to see an adapter off the panel for a generator to be added in an emergency. They are meeting with the Con Comm tonight; there isn’t a wetlands issue but there is one area that work will be done in a buffer zone. There are 3 acres of the land that will be set aside as a “common area”.
- John has a few catalogs for the rabies poles; he’s going to show them to Chief Backhaus to see which style he likes better.
- The next Board of Health meeting will be on March 23rd.
- Mt Hunger subdivision: Peter stated he hasn’t received any more information but he plans to attend the Planning Board meeting on Thursday night.
- The Board was made aware of an online review posted from a person that stayed at the “Art School Road Inn” in 2007. Since the residents still have not applied for the proper permits the Board questioned whether or not Town Counsel should be contacted on the matter. The Board did not feel this was a big issue they would just like the applicant to apply for the proper permits.
- Nora Hayes came in to update the Board about the Public Service the Mike Cahill and Nora did on WSBS on Thursday regarding rabies. She received a call later in the day from Marge Gulick complimenting her on a job well done. Nora spoke with Marge about the recent conversations around town that stated Marge wouldn’t accept dogs from her. Marge stated that was a total miscommunication and that what she meant was she wouldn’t take dogs from individuals in Monterey without the approval of the ACO. She was upset at the article in the Monterey News that stated that the Police were looking to the job of the ACO (this was taken from the Board of Health meeting minutes and was a conversation the Police Chief had with the Board but it was not the Board’s view). The Board stressed that to eliminate
the rumors and heresay that are running around town that the ACO, Police Chief, Board of Health and Select Board all need to meet. The Board confirmed that they are not looking for a new ACO but agreed that the communication between departments needs to be improved.
