Board of Health Minutes 10/6/08
MONTEREY BOARD OF HEALTH MEETING MINUTES

Date:  October 6, 2008
Present:  John Makuc, Robert Annelli, Stephen Enoch and Peter Kolodziej
Also Present: Brent White of White Engineering and Attorney David Hellman

The meeting began at 3:45pm

1.      The minutes from 9/15 were approved as written.
2.      Mail was reviewed.
3.      The Board reviewed the ZBA application for Carry at 29 Broderick Rd.  Brent White, engineer for the Carry’s was also present to answer any questions.  A septic repair permit was issued in November of 2007. The Board responded to the ZBA with the following:  The Board approved the plan as submitted and a septic permit was issued in October of 2007.
4.      Peter reviewed with the Board his conversations with Town Counsel with regards to the Board’s concerns with the USPS special permit application.  A letter is being sent to the Monterey Water Company advising them of items the Board feels should be reviewed prior to construction.
5.      The Board discussed the letter received from Kutsher’s Sports Academy’s attorney stating that they will not be paying the $5000.00 fine imposed by the Board of Health for operating 2 camps without the proper permits and the Board’s options with regards to this matter.  Peter Kolodziej also updated the Board on a meeting held on Friday at the camp with DEP regarding their listing as public water supply and the issues DEP has with the proper testing not being performed that is required when you are a public water supply.  DEP has stated that the camp was clearly in violation and they will be taking actions against the camp which may include fines and/or other actions.  The Board attempted to reach Town Counsel to discuss the options available with no luck.  Pending Town Counsel’s official opinion the Board voted to withhold issuing any permits from any Town departments until the fine is paid.  If Town Counsel advises in the meantime that pursuing legal action is the better option the Board agreed to let him start the proceedings without waiting for their next meeting.
6.      The next Board of Health meeting will be on October 20th at 3:30.
