MONTEREY BOARD OF HEALTH MEETING MINUTES
Date: January 14, 2008
Present: Stephen Enoch, John Makuc, Robert Annelli and Peter Kolodziej
The meeting began at 3:45pm
1. Mail was reviewed.
2. The Board held a hearing as posted in the 12/21/07 Berkshire Record to discuss and act on proposed changes to the Regulations of the Monterey Board of Health Sale of Tobacco Products to Minors. The Board reviewed the DRAFT Action Plan YA Regulations and made modifications to the fines and suspensions imposed to the store owner and sales clerk. A motion was made and unanimously approved to change the fines as suggested. The modifications will be made by Tri Town Health and emailed to the Board to sign at their next meeting.
3. John summarized for the Board his meeting with the Select Board this morning regarding the mutual aid agreement sent in from the Berkshire Regional Planning Commission.
4. Peter Kolodziej updated the Board on his conversations with DEP regarding the hearing scheduled for January 29th against Erik Kirchner for falsifying a Title 5 Inspection Report.
5. There will be another hearing on the 29th with the owners of the Blue Heron Landing for Building and Board of Health violations. The board reviewed the letter sent by the Building Inspector dated December 18, 2007.
6. Nora Hayes, ACO came in to discuss the following with the Board:
a. Mileage reimbursement requests: Nora stated that she accidentally submitted the mileage as she submits that for Otis and just assumed that she was paid the same way in Monterey. The Town Accountant informed Nora that her salary includes these incidentals unless the Board approved that additional expense. The Board did inform Nora that the mileage would be calculated from the Town Hall as a starting point.
b. There is a chronic loose dog issue at a residence on Mt Hunger Rd. Nora feels that the dog is at risk and the family is unable financially to fix the situation. The dog is not fixed and neighbors are threatening harm to the dog if it continues to come on their property attacking their dog. Nora stated that this is allowed under MGL if you are afraid for the safety and welfare of your own animals or family. Nora is working on placing this animal at the Sonsini Animal Shelter and it may be an issue as it’s against the family’s wishes.
c. Nora is interested in doing more bite prevention training (this isn’t currently part of her job description), she’d like to be proactive and stop these types of incidents through education before they happen. New England Keswick is willing to let Nora use their conference center free of charge when they aren’t using it. The Board supports this completely. Nora stated that since this isn’t part of her current job description she’s not paid for this. The Board suggested looking into grant money and being hired as a dog trainer not as the ACO. Nora plans to add it into her FY09 budget request. Peter Kolodziej suggested contacting the ACO Board she belongs to to find out if this has been done before and use their resources.
d. Nora provided the Board with an article she wrote for the Otis Gazette.
7. Don Bernard, owner of the Seven Stones property and Matt Puntin came in to discuss a septic system upgrade that was done in 2000. The project was phased out into 2 phases, phase 1 was completed and they’d now like to finish phase 2 (the current permit has expired). Peter Kolodziej recommended showing their proposal to the Building Inspector as well to make sure there aren’t any certifications or inspections that will be necessary prior to occupancy. Peter Kolodziej stated that phase 2 would be considered an upgrade ($200). The Board stated that they would also need verification of the number of bedrooms.
8. The Board approved the minutes as written from the December 10th and December 17th meetings.
9. John Makuc stated that there is another mini grant available that is due tomorrow that he will submit.
10. The Board will next meet at their regularly scheduled meeting on February 4th.
