MONTEREY BOARD OF HEALTH MEETING MINUTES

Date:  September 17, 2007
Present:  Stephen Enoch (arrived at 4:05pm), John Makuc (arrived at 3:55pm), Peter Kolodziej and Robert Annelli

The meeting began at 3:45pm
1.      The minutes from 9.10.07 were approved as written.
2.      Mail was reviewed.
3.      Marshall White of White Engineering came in to provide a floor plan for a proposed 5 bedroom home for the Alpert property at 177 Mt Hunger Rd.  The Board reviewed the plans and will be contacting the engineer with their suggestion to increase the capacity to 6 pr 7 bedrooms, it is suitable for approval as submitted if the owners are unwilling to do that.
4.      Mike Parsons and Tom Rosenthal came in to discuss the proposed project at 10 Riverwood Way.  Mike Kulig from Berkshire Engineering was also present.  The septic system designed is a FAST system to satisfy the Conservation Commission due to how close it is to the wetlands.  Peter Kolodziej explained that the 150ft setback requirement is a town requirement.  An abutter was present and questioned the perc test pits done near the gravel access road.  Mike Parsons noted that the Conservation Commission would have issued an OOC to move the project forward if a filing number had been received by the DEP; this was continued by the Conservation Commission to their October meeting.  The board reviewed the plans submitted and more information was needed; Peter Kolodziej will call Mike Parsons.
5.      Mike Parsons and Matt Puntin came in to discuss the Lombardo project at 188 Hupi Rd.  The applicant is proposing a garage with 2 bedrooms above it and a separate septic system.  An application, plans and permit fee were submitted.  The Board reviewed the plans and needs a floor plan to confirm 2 bedrooms before they can approve it
6.      The Board discussed a proposed project at 29 Broderick Rd; initially a septic system done by White Engineering had been approved.  The owner is now changing the footprint which requires a special permit so new plans have been submitted by Soil Tech.  It was confirmed that on the father’s adjacent lot there is a reserve area.  R. Annelli was questioning what would happen with this case if one of the lots were to be sold (deed restrictions could be placed).  This was approved subject to confirmation of the owner (Arthur or William) with the correct map and lot number, submit confirmation of a legal easement for the son to construct a septic system in the area designated on Perc & Soil Evaluations conducted by John Bolling on 9/14/07.  A letter will be sent to William Carry.
7.      Pasteurization permit for Gould Farm was approved and will be issued.
8.      The board reviewed the legal packet received from an attorney representing a local contractor regarding 34 Art School Rd.  The Board needs to decide if they want to pursue any action against the owners for operating an illegal inn (information is in the packet confirming they have rented rooms beyond the capacity allowed without a permit).  The Board will meet with the Select Board on 9/24/07 to determine the course of action.
9.      The Gould Farm and Kalodner septic applications were approved by the Board of Health agent, Peter Kolodziej last week.
