MONTEREY BOARD OF HEALTH MEETING MINUTES
Date: July 23, 2007
Present: Stephen Enoch, Peter Kolodziej and Robert Annelli
The meeting began at 3:45 pm
1. The minutes from 7.2.07 were approved as written.
2. Mail was reviewed.
3. Mike Parsons of Kelly, Granger and Parsons presented the plans for Kirson on Seven Arts (approved) and for Rosenthal on Riverwood Way (Board needs to review further).
4. Open discussion about the recent contamination of the Pedersen well and the potential source of that contamination. Those present: Dick Tryon, Roger Tryon, Debra Pedersen, Mrs. Duryea, Laurily Epstein, Kenn Basler, Scott Jenssen, Liz Thorn and Steve Thorn. The Board of Health asked all those interested to attend this meeting to discuss a process for fertilizing fields with nitrogen in an attempt to come up with a way to notify abutters when fertilization of fields is going to occur and to identify surrounding wells that could be affected. D. Tryon read off his records of past fertilization applications to show the low level of nitrogen used (copies were not provided to the board). The board’s intentions were (and will continue to be) to involve all
parties to protect public and private water supply sources. The Tryon’s and Duryea’s felt that the Board of Health were accusing them as the source of the contamination, the Board would like to make it clear that they stated that the fertilization of the field may have been the source of the contamination and that is what prompted the informal meeting. K. Basler came in as a representative of the right to farm bylaw and wanted to make sure that there wasn’t going to be any regulations to prevent local farming. The Board stressed that what they are trying to accomplish is a notification process to abutters of fertilization applications and making those applying the nitrogen aware of the locations of surrounding wells. The Board agreed that there are other possible sources of contamination besides field fertilization and noted that the reason they focused on the field fertilization was because of the timing of the
application, the type of application (nitrogen) and the proximity to the well having problems. Mrs. Duryea questioned why it appeared that she was the only person to receive the letter from the Board. R. Annelli stated that he personally went to speak with Richard Tryon to let him know that there was a contaminated well in the area and that he should notify anyone near where he spread the fertilizer. The letter from the board was only sent to the Duryea’s and Tryon’s as a follow up to conversations that had taken place and were still ongoing between Dale Duryea and Monterey Health Agent, Peter Kolodziej. The Board felt that was important to notify all those that abutted the contaminated well since the cause of the contamination was unknown. Future meetings to discuss proactive preventative measures to protect water supplies while encouraging farming will be scheduled.
5. S. Jenssen, Select Board Member, asked the Board if there was anyway to put pressure on the homeowner’s of the house on Sylvan Rd that several neighbors are complaining about. P. Kolodziej noted that he has made several site visits and did not see any public health concerns that would warrant the Board stepping in.
