MONTEREY BOARD OF HEALTH MEETING MINUTES

Date:  June 5, 2006

Present:  Stephen Enoch, Melissa Noe (clerk), Nora Hayes ACO, Robert Annelli & John Makuc

Also in attendance: Chief of Police Gareth Backhaus, Valerie Zantay representing the West Road Association, and Steve Sedden representing the owners of 40 Beartown Mtn Rd

The meeting began at 3:45pm

·       Approved minutes as written from 5/15/06
·       Reviewed mail
·       The Board, ACO and Chief of Police reviewed the procedures for animal calls and will submit something in writing to the Select Board, Monterey News and police dispatch.  All calls will go to Police Dispatch, and the police and ACO will be dispatched at the same time and the scene will be assessed, if it appears rabid, the police will shoot the animal and ACO will dispose of the carcass, for all other issues the ACO will handle accordingly.  An announcement will also be sent to the Monterey News announcing Nora Hayes as our new ACO.  A key to the Town Hall will be issued to Nora and prices and sizes of a chest fridge will be researched.  The citation book that the Police Department has will be passed along to the ACO.  Nora will also be added as an Animal Inspector so she that she will be able to quarantine animals.
·       Valerie Zantay came in to discuss a septic system going in near her house on Pine St. for the West Rd Association.  The lot is a non conforming lot that is grandfathered and they are concerned with all the surrounding wells.  The Board advised that easements would be required for any infringements on other properties and they would need to meet the 100ft setback from all 5 wells.
·       Steven Sedden came in with a proposed garage for 40 Beartown Mtn Rd with a septic design from Randy Leonard from initial installation.  After reviewing an engineered septic plan the Board determined that it’s designed for 3 bedrooms and as long as it stays 3 bedrooms no upgrade is necessary.  They will need a permit for a repair to add the line.
·       The ad for a camp on Art School Rd was discussed and further conversations will take place with our health agent to determine if they need a camp permit or not
·       Fees for septic permits were discussed and whether or not a repair should be a different amount than a new or upgraded system.  This will be tabled and discussed at the next meeting.
·       The Board discussed what actions to take regarding a septic that was installed by Wilkinson Excavating without a permit issued by the Board of Health.  The Board voted to fine the installer 2 to 1 and will determine this amount after speaking with the Monterey Health Agent.  With the fine will be a letter stating that if there is another infraction the board may vote to withdraw their license to install in the Town of Monterey.
·       The packet from the ZBA for an upcoming hearing from the Brenner’s was reviewed and a letter was written to the ZBA and will be sent out after the Monterey Health Agent has had a chance to review.
·       Stephen Enoch has received 2 complaints about the Building Commissioner’s interpretation of a kitchen and the Board has determined that it would not affect how the Board approves applications and makes decisions.
·       The article in the Sunday Berkshire Eagle was discussed regarding the rise in rabies cases in the Berkshires.
