The meeting convened at 6:10p.m.
Friends of Lake Garfield – NOI – control nuisance and non-native plant growth in Lake Garfield (C. Crane is the project manager)
The hearing was reopened, continued from June. The FLG have requested to withdrawn their NOI application. A motion was made to accept the applicant’s request to withdraw their application. The motion was seconded and unanimously approved.
Ryan – 136 Tyringham Rd - to construct a barn at site of historic agricultural excavation and clear trees for silvopasture (Stucker) (D. Stucker is the project manager)
The hearing was reopened, continued from June. Dave consulted with our representative Mark Stinson at Dep and it was confirmed that this application can be approved as a N2 or a N5 and that the exempt activity falls under 310 CMR 10.04 agriculture b.3, 9, 15, 16 and 310 CMR 10.58 (2)(a)3.c. A motion was made to approve it as submitted as a N5, the motion was seconded and approved unanimously.
40 Sylvan LLC – NOI – to reconstruct existing dwelling and remove trees (D. Dempsey is the project manager)
Chris Tryon of Berkshire Geo-Technologies was present to review the project details. A DEP file number has not yet been received nor have any comments from Natural Heritage. Chris reviewed the project details with the Commission. A motion was made to continue this hearing to the August meeting while we wait for a file number and comments from Natural Heritage. The motion was seconded and approved unanimously. In the meantime trees will be flagged and a site visit will be made to discuss vegetation to be planted. Abutters were present that voiced their concern about the number of trees proposed to be taken out and the impact it will have on the neighborhood and Ladd’s Beach.
22 Bidwell – RDA - to remove invasive phragmites and coltsfoot, stabilize bank, grade walking area, and plant trees (T. Lovett is the project manager)
Tom Ingersoll, representative for the Schmidt’s was present to review the project details. Tom will submit a separate, more detailed summary of the project. A motion was made to approve the project as submitted as a N3. The motion was seconded and unanimously approved.
For Discussion:
- Mail was reviewed.
- Minutes from 6/14/16 were approved as written.
- Steve Kelleher and Francis Parisi came before the Commission to talk about the Order of Conditions issued for the construction of a cell tower on Chestnut Hill which is still good under the permit extension act through 2018. The Commission confirmed that the permit is still good. They also noted that work that has been done on the property for another project affects the original plans submitted and they wanted to confirm that this was acceptable. They are seeking some waivers on some of the previous requirements to the access road. The Commission stated that the updates to the plan could be done administratively rather than requesting an amended OOC and formally filing.
- An owner of a dam that is in New Marlborough but will affect Monterey requested to be able to hold a joint meeting instead of 2 separate meeting to request to lower the dam.
- Steve Weisz, Selectman came in to discuss the Lake Garfield Working Group being organized and how the mission statement has one member of the Con Comm serving on it. The members present did not have the time to personally serve on the group and some had concerns about a conflict but suggested that Dominic Stucker who was unable to be at tonight’s meeting may be interested.
- Dennis reported that he was contacted by a resident on Steven’s Lake regarding a possible violation and clear cutting a road. Tim noted that the Commission cannot enter private property without the owner’s permission – if they can see the violation from another public spot or from a spot where they’ve been given permission then we can act on it.
