CONSERVATION COMMISSION

Present: Timothy Lovett, David Dempsey, Dennis Lynch, Claudia Crane and Dominic Stucker
The meeting convened at 6:00p.m.

Wolinsky – RDA – 6 Lakeside Ave – to renovate an existing cottage (T. Lovett is the project manager)
David Emmel, Harry Wolinsky and Barbara Wolinsky were present to review the proposed project.  A letter was submitted for the record from Attorney Glover representing one of the trustees of the property.  The proposal was approved as a N3 with the condition that a silt fence must be installed as indicated on the drawings.

Friends of Lake Garfield – NOI – control nuisance and non-native plant growth in Lake Garfield (C. Crane is the project manager)
A motion was made to rescind the denied vote made at the May meeting.  The motion was seconded and approved unanimously.  This hearing was opened as a new hearing after being reposted in the newspaper and abutters re-notified.  Mike Germain, Ken Wagner, Richard Jaffe and Attorney Bickman were present to review the project details.  Dr. Wagner states that there is about 12 acres of milfoil in Lake Garfield which can no longer be addressed with just the drawdown and will need an herbicide or additional suction harvesting to mostly eradicate it.  It was explained by the Commission that the reason last month’s decision was rescinded was because we were informed by DEP that the denial issue was unfounded and therefore the applicant had the right to appeal directly to DEP or the Con Comm could “re-open” the hearing.  Steve Weisz pointed out that there is at least one residence using the lake for their drinking water and the Board of Health has been notified.  Members of the audience inquired as to why a moratorium on motorboats in the lake was not placed in addition to the chemical ban.  Jon Sylbert felt that the Con Comm didn’t have to approve this application just because someone submitted it, under whose authority does the FLG have the right to manage the lake (they are not the owner) and suggested that the Con Comm hire an independent consultant to aid them in making the decision for this application.  Pat Solomon inquired about what the Con Comm could do proactively to assist with the health of our lake.  The Commission heard all comments and then unanimously voted to close the public portion of the hearing.

The hearing will be continued to the July 12th meeting to allow the Con Comm to seek advice from counsel and DEP.  At the July meeting the Commission will approve or deny the application and work on any applicable conditions which will have to include the comments/stipulation from the Natural Heritage.  Dennis was in favor of hiring an outside consultant.

Ryan – 136 Tyringham Rd - to construct a barn at site of historic agricultural excavation and clear trees for silvopasture (D. Stucker is the project manager)
Tom Ryan was present to review the project details.  The Commission continued this hearing to the July 12th meeting to seek guidance from DEP.

  • The Commission has rescinded the vote to donate $100 to the BNRC as the Accountant has informed us that this is prohibited under the anti-aid amendment
