CONSERVATION COMMISSION

MEETING DATE: 5/10/16
Present: Timothy Lovett, David Dempsey, Dennis Lynch, Claudia Crane and Dominic Stucker
The meeting convened at 6:00p.m.
Also present: Steve Weisz, Carol Edelman, Alice Berke, Jon Sylbert, Bonner McAllester, Juliana Raab, Judy Bach, Pat Edelstein, Gerald Raab and Ann Duryea

Friends of Lake Garfield – NOI – control nuisance and non-native plant growth in Lake Garfield (C. Crane is the project manager)
An email from the applicant was read requesting a continuance; they were not present.  Steve Weisz, Selectman presented an email opinion from Counsel in light of the fact that the town voted a one year ban on herbicides in Lake Garfield and Brewer’s Pond that is effective May 7, 2016, that the NOI must be denied instead of continued or withdrawn by the applicant and later refiled.  There was discussion about whether or not the application should be considered as it was submitted prior to the town meeting vote.  Discussion also ensued about the use of the word “and” in the project description instead of “or” which would have provided a bit more flexibility. A letter was submitted by the Select Board stating that they do not support the use of chemicals in the lake. After much discussion the Commission closed the public portion of the hearing to deliberate.  A motion was made to deny the application.  The motion was seconded and passed 4 – 1 with Dave Dempsey abstaining.  There was a question after the hearing whether Town Counsel actually read the NOI prior to giving his opinion.  

For Discussion:
  • Mail was reviewed.
  • Minutes from 4/12/16 were approved as written.
  • The Commission agreed to ask the Select Board to sign a letter supporting the proposed designation of a Western Mass Forest Legacy Area.
  • The Commission discussed donating to the BNRC.  Tim recused himself from this discussion.  They agreed to donate $100.00
