CONSERVATION COMMISSION
Town of Monterey, Massachusetts
MEETING DATE: 5/12/15
Present: David Dempsey, Christopher Blair, Pat Edelstein and Dennis Lynch
The meeting convened at 6:00p.m.
Ferraro – 12 Sylvan Rd – RDA - lift the house, dig out existing 6’ cellar, pour concrete foundation and add an interior entrance to basement (Lynch/Dempsey is the project manager)
A brief description of the project was given. The Commission inquired if a special permit was necessary, the applicant was not sure. The Commission noted that any excavated soil cannot be put back. Soils need to be covered each night. The project was approved as submitted as a N3 with the following additional conditions 1. All excavated materials will be stockpiled on the general parking area and anything in excess of backfill under the slab and around the walls will have to be moved off site 2. Material should be covered at the end of the workday with a plastic sheet to prevent erosion 3. Silt fence to be installed as shown and 4. Call Dennis Lynch at 528-5245 once silt fence is installed for inspection.
Barlow – 34 Camp Half Moon Rd – RDA – reconstruct/expand a +/- 130 sq ft existing rear deck and a +/- 16 sq ft front deck (Edelstein/Blair is the project manager)
Rob Akroyd was present to review the project details. The previous Enforcement Ordered that was issued has been satisfied and closed. The Commission approved the project as submitted as a N3 and reminded the applicant that a building permit will also be necessary prior to beginning this project. The following conditions were set: 1. No materials used in the construction of the deck shall be CCA pressure treated 2. Erosion controls are to be installed as specified in the plans 3. The owner will install several helical screw piers on the downside of the logs placed to retain soil so that the logs are staked. 4. Contact Pat Edelstein at 528-8803 when erosion control is in place. 5. The owner in consultation with his site professional shall come up with a plan to install 18-24 pieces of native plant material
post construction (to be determined).
Ferencz – Mt Hunger Rd – RDA – Lot clearing for construction of single family home (Lovett is the project manager)
Paul Ferencz was present to review the proposed project. Logging is currently taking place which has been permitted thru the state. The Commission approved the project as submitted as a N1.
Gould Farm – 100 Gould Rd – RDA – install a curtain drain and catch basin within buffer zone of intermittent stream and pond (Dempsey is the project manager)
Chris Tryon of Berkshire Geo-Technologies was present to review the project. There was discussion and concern about the discharge into a stream. The Commission approved it as submitted as a N2 and requested that inspection reports of the basin be submitted to the Commission by Gould Farm twice a year which should include their intention of whether or not it will be cleaned and what condition the outlet hood was found to be in. Erosion controls must be installed as shown on the drawings and rake, seed and mulch all disturbed areas. Call Dave Dempsey for inspection once erosion controls are installed.
Lake Garfield – NOI – Diver assisted suction harvesting of invasive Eurasian watermilfoil (Dempsey is the project manager)
The Commission discussed the conditions to be set for the issuing of the Order of Conditions. A draft list was created and will be finalized via email and available for viewing at town hall.
For Discussion:
1. Mail was reviewed.
2. Minutes from 4/14/15 were approved as written.
3. Susan Bachelder came in to discuss requirements for restoration of the right of way after the installation of her well. She provided a copy of the judgment relating to litigation that surrounded the right of way. According to the judgment nothing is to be in the right of way except for the deck that is currently there which needs to be brought up to building code. There is a dock permit that should be forthcoming from another property and is not allowed to have any motorized vehicles attached to it. Four years ago Susan was instructed by
the Conservation Commission to replace the trees removed in the right of way that were removed to install her well however the judgment states that nothing is allowed there. After reviewing the documents it was confirmed that the 2 trees that were to be replaced in the right of way should not be. The Commission will review the Determination of Applicability and the judgment and will then write a letter.
4. Susan also inquired about the Commission’s dock guideline specifically #4 that has to do with moorings and floats. She stated that DEP has no siting guidelines and our guidelines state that the Harbormaster in Monterey is the one charged with issuing these permits locally which is Chris Cobb for Lake Buel and Chief Backhaus for Lake Garfield. Susan is concerned that an annual bottom anchor permit could be issued to anyone for placing in proximity to the right of way or abutting properties for their boat since they may not be able to put a dock in. She hopes that whoever is issuing these permits will take into consideration before issuing one near this piece of land that may impede swimmers, etc.
5. Steve Weisz came in to introduce himself as the newest member of the Select Board and to let the Commission know that he is here and willing to help with any struggles the Commission may be facing and how the Select Board can help. The Commission stated that reinstituting the quarterly all boards meetings would be helpful (which coincidentally is a town bylaw) at least 2-3 times a year.
