Conservation Commission Minutes 2/10/15
CONSERVATION COMMISSION
Town of Monterey, Massachusetts
                                                                        
MEETING DATE: February 10, 2015
Present: Christopher Blair, Pat Edelstein and Dennis Lynch
The meeting convened at 6:00p.m.

Slone – 16 Point Rd – NOI – reconstruct existing house and dock, expand parking area, upgrade septic and remove trees (D. Lynch is the project manager)
This hearing was continued from last month.  Chris and Kelly Tryon of Berkshire Geo-Technologies were present to provide additional information.  A DEP filing number was assigned (230-0274) and the Natural Heritage comments were received.  The project was approved with conditions.

Town – follow up on Enforcement order issued
Chris and Kelly Tryon of Berkshire Geo-Technologies were present to discuss closing this out.  An original copy of the order was not available.  The Commission is waiting to hear that the thresholds were not exceed or if they were exceeded was there mitigation that occurred for that area.  This will be followed up on at the next meeting.

Mandelbaum – 521 Main Rd – RDA - remove and replace an existing boat house (T. Lovett is the project manager)
Shannon Boomsma of White Engineering was present to review the project details.  Also present were abutters Anna Duryea and Thomas Thorn.  Anna and Thomas stated that they have had many issues with the current owner respecting the property lines.  The Commission stated that violations of boundaries does not fall under the jurisdiction of the Commission and is a civil matter.  Anna and Thomas stated that they are here to express concerns over how this project will be handled and if additional water is going to be diverted to their property and that they are opposed to the approval of this project.  The Commission notified Anna and Thomas that there is a period of time that they are able to appeal any decision to the State made by the Commission.  The project was approved as submitted as a N3 with conditions.

Bergman/Seven Arts Condo Assoc – Seven Arts Rd – RDA – to construct a seasonal recreational use dock (P. Edelstein is the project manager)
Stephen Booher of Walk on Water Docks was present to review the project details.  Kyle Haver, abutter was also present for this discussion.  Letters sent in by abutters were reviewed.  The abutters were mostly concerned with safety and were directed to the Chapter 91 waterways division.  The project was approved as a N2.

For Discussion:
1.  Mail was reviewed.
2.  Minutes from 1/13/15 were approved as written.
3.  The Commission discussed the outstanding enforcement orders on the agenda.
