CONSERVATION COMMISSION

Present: David Dempsey, Christopher Blair, Betty Pixley, Pat Edelstein and Dennis Lynch
The meeting convened at 6:00p.m.
Armstrong – 471 Main Rd – RDA – to demo an existing 22 x 22 shed and replace with new 24 x 24 garage (T. Lovett is the project manager)
Andrew Kurtz, Contractor and homeowner David Armstrong were present to review the project. David clarified that the existing building is really a garage and not a shed as was described in the RDA. The Commission approved the project as a N3 with the following conditions: 1. Install silt fence as shown; 2. Stock pile spoils and excavated materials as shown.
Timlege – 26 Mt Hunger Rd – SMARDA – SMA15-01 & RDA – construct a 30x32 horse barn and pasture area (B. Pixley is the project manager)
Beth Timlege was present to review the project details. DEP commented on the project and felt that there were more wetlands than were depicted on the plans. The Commission advised Beth to speak with the Building Inspector to determine how close the fence can be to the property boundaries before putting in any fencing. The number of trees to be taken down was discussed; Beth does not plan on doing any clear cutting just removing the poisonous ones to the horses and a select few others. The project was approved as a N3 with the following conditions: keeping the fence 10 feet east of the edge of the wetland and mark the trees and get approval/inspection before cutting them down and the paddock area has a distribution area allowing some trees to remain and to install about 100 feet of silt fence
between the activity and the wetland. Provide a new map that shows where the wetland flags are located. The SMA RDA was approved with a negative determination as the activity described will not have a substantial impact on the scenic qualities of the mountain area and is therefore not a regulated activity.
Gould Farm – 100 Gould Rd – NOI – install a new effluent disposal system and associated pump station and force main (C. Blair is the project manager)
Eric Martin of Gould Farm was present to review the project details which are changes to the current lagoon system. The public hearing was closed and the board deliberated on the dimensions of work in the buffer zone and river zone. The Commission approved the project with the following special conditions (Dennis Lynch abstained):
1. ON SITE CONFERENCE (1) In advance of any work on this project the applicant shall notify the Monterey Conservation Commission, shall arrange an on-site conference among the MCC, and at the request of the MCC, the contractor and the applicant to ensure that all of the conditions of this Order are understood. This Order also shall be made apart of the contractor's written contract, and shall supersede other contract requirements.
2. NOTIFICATION OF SUPERVISOR (2) The applicant shall inform the Monterey Conservation Commission in writing of the names, addresses, business and home phone numbers of both the project supervisor who will be responsible for ensuring on-site compliance with this Order, and his/her alternate.
3. CONTROL OF FUELS AND POLLUTANTS (14A) During and after work on this project, there shall be no discharge or spillage of fuel, oil or other pollutants onto any part of the site. The applicant shall take all reasonable precautions to prevent the release of pollutants by ignorance, accident or vandalism.
4. STABILIZATION OF UPLAND AREAS (17) As soon as possible during construction, all disturbed upland areas shall be brought to final finished grade and either (a) loamed and seeded in accordance with USDA Soil Conservation Service Guidelines for permanent stabilization, or (b) stabilized in another way approved by Monterey Conservation Commission. Bare ground that cannot be permanently stabilized within 30 days shall be stabilized by temporary measures acceptable to the Monterey Conservation Commission.
5. ENGINEER SIGN OFF (31) Prior to the issuance of a Certificate of Compliance, the applicant shall submit a letter to the Monterey Conservation Commission from a registered professional engineer certifying that the work is in compliance with the plans referenced above and all the conditions hereof.
DEP has not yet issued comments so the Commission is going to wait to hear from them before issuing the OOC. A letter is going to be sent to the engineer, Tryon Construction and Gould Farm that they neglected to file under the SMA for their project however the Commission will accept in lieu of filing a simple, concise statement of erosion management before, during and after the project.
For Discussion:
1. Mail was reviewed.
2. Minutes from 7/8/14 were approved as written.
3. The Emergency Certification for 10 Phelps Rd was signed.
4. Update on the Barlow property Enforcement Order issued to 34 Camp Half Moon Rd: Chris met with Rob Ackroyd at the property and there were a couple of trees still left in the wetland. A letter is going to be sent to the homeowner stating that a site visit was made on 8/12 and that the Commission is happy with the progress made with the clean-up and the Enforcement Order has been cleared.
5. Peter Chait came in to ask what kind of permission would be required to install a boat lift. He has 2 docks and the lift will be in addition to the docks. Peter is filing for an amendment to his Chapter 91 license and is requesting a letter from the Commission stating that they have no objections to him installing a boat lift. The Commission recommended that Peter file a RDA. Dave found a section that would allow the Commission to sign off on the lift with a letter stating that Peter would be getting permission from the Harbormaster. Chris will research and provide the correct section to include in the letter.
6. The Commission reviewed the special permit application for 34 Camp Half Moon Rd and responded to the ZBA with the following: The Monterey Conservation Commission reviewed the ZBA Special Permit Application for Barlow of 34 Camp Half Moon Rd. The Commission has just concluded an Enforcement Order which the applicant has satisfactorily completed the conditions of and have no objections to the special permit being granted at this time as we will review Conservation Commission Project Review form which will be submitted when they file for a building permit at which time a member of the Commission will make a site visit and determination if the project falls under our jurisdiction.
7. Chris provided an update on the cell tower road and complaints received from an abutter as well as the letters sent by the Commission to the engineer and tower owners.
