CONSERVATION COMMISSION
Town of Monterey, Massachusetts
MEETING DATE: July 8, 2014
Present: Timothy Lovett, David Dempsey, Christopher Blair and Betty Pixley
The meeting convened at 6:00p.m.
Wolinsky – 6 Lakeside Ave – RDA - to cut down 5 trees within the buffer zone of Lake Garfield (C. Blair is the project manager)
The hearing was opened but no representative was present. The hearing was reopened later in the meeting when Mrs. Wolinsky’s brother David Emmel came to present the project. The project was approved as a N3.
Gottlieb – 3 Carl’s Lane – NOI #230-0271 – construction of a cart path to access waterfront and SMA NOI – SMA14-03 – construction of pool house, pool and cart path to Lake Garfield (D. Dempsey is the project manager)
Shannon Boomsma of White Engineering was present to review the project details. The owners and architect were present at the meeting. On the SMA and the WPA application the cart path as proposed is causing a little bit of an issue. On the SMA application the first switchback on the list seems tremendously difficult. On the WPA application the length of the final switchback seems long and the Commission would like to see it shortened. A motion was made to close the WPA NOI and the SMA NOI and deliberate on both.
It was determined that as there isn’t any monetary gain for Tim Lovett who is also an abutter to this property that he did not need to recuse himself (it was noted that he also sat in on previous hearing with regards to this property).
A preliminary approval has been received from the Natural Heritage and the applicant is working solely in the buffer zone. The following additional conditions were made for the WPA OOC:
- Execute the project in conformance with the requirements of the Natural Heritage
- Install the silt fence as shown on the drawings
- A revision in the drawings should be provided to the Commission shortening the last run of the path to get out of the previously cut area
- Call Dave Dempsey (528-6996) 24 hours prior to construction begins
- Produce a document showing the restoration data
- Have a job site meeting with at least David Dempsey and/or any other Conservation Commission members, the prime contractor, the landscape contractor and the site contractor with a set of the current project plans. This will be a requirement before any construction commences.
The following additional conditions were made for the SMA OOC:
- Reconstruct the viewing platform and remove the sumac. Removal of plant materials to be sumac around the viewing platform.
- A medium value or darker finish shall be used on the path finish, not white
- All of the trees that are coming out should be marked at the same time the silt fence is installed and viewed at the initial site meeting. Provide a document showing the restoration data to the Conservation Commission
- Execute the project in conformance with the requirements of the Natural Heritage
- Have a job site meeting with at least David Dempsey and/or any other Conservation Commission members, the prime contractor, the landscape contractor and the site contractor with a set of the current project plans. This will be a requirement before any construction commences.
Both the SMA OOC and the WPA OOC were approved with the conditions listed above.
For Discussion:
1. Mail was reviewed.
2. Minutes from 6/10/14 were approved as written.
3. Chris made a site visit to the Barlow property at 34 Camp Half Moon Rd and they have flagged the wetlands, the trees that were dropped were situated in the buffer zone but dropped into the wetlands. Chris has spoken with Rob Ackroyd their representative and has asked them to speed up the process of removing the trees from the wetlands. A letter will be sent to the Barlows and Rob Ackroyd stating that for any more constructive activity or retaining walls that involve any of the steep slopes a plan must be submitted to the Conservation Commission for approval. The Commission does not feel that timber used as a retaining structure is not sufficient in scope and another method must be found. Substantial completion of the work being done now must be completed by our August 12, 2014 meeting.
4. Pat Edelstein and Dennis Lynch were present and showed interest in becoming members of the Conservation Commission. Julio Rodriguez and Susan Gallant also showed interest but were unable to attend tonight’s meeting. Betty Pixley stated that she will also soon be resigning from the Commission. Chris is going to speak to the other two people that were interested and make a final decision on who should be recommended to the Select Board to be appointed to the Conservation Commission.
5. The Board reviewed the ZBA application for 22 Limerock Lane, Chris recused himself as he has a direct involvement in this project. The Commission determined that the at this point the Conservation Commission has no objections to the Special Permit being granted.
6. The Board reviewed the ZBA application for 244 Mt Hunger Rd. The Commission determined that the at this point the Conservation Commission has no objections to the Special Permit being granted. When the applicant files for their building permit they will need to submit a Conservation Commission Project Review form at which time a member of the Commission will make a site visit and determination if the project falls under our jurisdiction.
