Conservation Commission Minutes 6/11/13
CONSERVATION COMMISSION
Town of Monterey, Massachusetts
                                                                        
MEETING DATE: June 11, 2013
Present: Timothy Lovett, David Dempsey, Christopher Blair and Betty Pixley
The meeting convened at 6:00p.m.

Hume – 73 Chestnut Hill Rd – NOI – seven foot drawdown of Stedman Pond for dam repairs & improvements (B. Pixley is the project manager)
Chris Tryon of Berkshire Geo-Technologies was present to request that the hearing be continued to the July meeting.

Litvack – 16 Laurel Banks - RDA – Construct a dock in Lake Buel (T. Lovett is the project manager)
The hearing from last month was continued to today and reopened.  Shannon Boomsma of White Engineering, representative for Mr. Litvack provided a revised configuration of the proposed dock.  The size was reduced from 410 sq. feet to 344 sq. feet and the width was reduced, it was centered on the stairs at the furthest point from the owner’s property lines.  The new plan is DWG NO: 13-04-01B dated June 12, 2013 (2 pages).  Alex Glover, Attorney for 2 abutters stated that the dock as it has been reconfigured is an improvement but she had questions for Shannon regarding its proposed location to the right of way shared by several abutters.  Shannon stated that the existing dock was designed by the previous owner and Mr. Litvack has applied for a new dock license to fit his needs.  It was noted that the only other property in the area with a permitted dock is the Bachelder property but there were arguments that her dock may not be placed where it is licensed for.  There is currently an ongoing lawsuit regarding property lines that hinders anyone applying for a dock license until the matter is resolved.  The Commission reiterated that the legal issues surrounding these properties and docks are the issues of the owners and the Commission has no jurisdiction with regards to those matters.  The Commission approved the project as a N2.

Flicker – 9 Buckingham Lane – RDA – Construct a stone patio within the buffer zone of Lake Garfield (B. Pixley is the project manager)
Chris Tryon of Berkshire Geo-Technologies was present to review the proposed project.  The Commission approved the project as submitted as a N3.

MassBroadband123 – Request for Cert of Comp DEP file #230-0261 (R. Andrus is the project manager)
The Commission reviewed the original project and signed off on the Certificate of Compliance.

For Discussion:
1.  Mail was reviewed.
2.  Minutes from 5.14.13 were approved as written.
3.  Chris Tryon of Berkshire Geo-Technologies provided the Commission with revised plans for the cell tower project at 31 Main Rd.
4.  A request was received from the owners of 527 Main Rd requesting permission to top a tall pine tree located very close to their house.  The Commission approved the request.
5.  An email request was received from John Fields notifying the Commission that they are planning on vista pruning with the outer 50’ of the 100’ buffer zone at the Wasserman property on Elephant Rock Rd.
6.  The Commission renewed their membership to the MACC.
