CONSERVATION COMMISSION

The meeting convened at 6:00p.m.
Hume – 73 Chestnut Hill Rd – NOI – seven foot drawdown of Stedman Pond for dam repairs & improvements (B. Pixley is the project manager)
This hearing was reopened (from Oct 2012), the applicant requested that it be continued to the May 14th, 2013 meeting as the Army Core of Engineers has made changes to the project. The Commission re-advertised the continuation of this hearing in the Berkshire Eagle since there had been such a lapse since it was originally presented. The Commission agreed to continue this until the May meeting and have a site visit on 5/13.
Hume – 73 Chestnut Hill Rd – SMA NOI – SMA13-02 (B. Pixley is the project manager)
The Commission opened the hearing and discussed that the filings for SMA and WPA shouldn’t overlap. This hearing will also be continued to the May meeting.
Small – 7 Buckingham Lane – RDA – replace existing failed septic system (C. Blair is the project manager)
Chris Tryon, representative for the Small’s was present to review the project. Chris Blair made a site visit with Chris Tryon prior to the meeting to review the details of the project. The existing system is starting to break out into the drainage swale. The applicant is proposing to install a new system comprised of a jet bat system which is an aeration chamber for advanced treatment. The leaching field will be a perc rite system. The grade will only be raised about a foot from where the existing driveway is. There are variances that will need to be granted by the Board of Health due to the minimal area they have to work with and surrounding wells. They are meeting with the Board of Health on April 22nd. The project was approved as a N3 providing the Board
of Health gives its approval. Abutter Maureen Regan was present and had no objections to the proposal.
Tryon – 445 Main Rd – RDA – Reconstruction of Tea Room and garage 2 in existing footprint (R. Andrus is the project manager)
Chris Tryon, representative for Leigh and Wendy Tryon presented the project to the Commission. The buildings are starting to fall down and the owners would like to reconstruct them in phases. This project will require a special permit from the ZBA as well. It will be in the same footprint as it is now. The Commission approved the project as a N2 and they reminded the applicant that the Determination of Applicability is only good for 2 years.
For Discussion:
1. Mail was reviewed.
2. Minutes from 3.12.13 were approved as written.
3. Eugene Bounous and his daughter came in to express concerns he has with the designs for the tower road on his property. Chris Tryon, engineer of the plans was also present to answer any questions. Chris stated that everything is working well. Eugene has a bone of contention with the one large detention pond that was installed and destroyed 5 acres of his property and that this pond was not on the set of plans he was given and approved. Eugene provided his own design which he feels would solve the issue. He states that the plan filed in the registry was after the fact and that they were not the plans approved by the ZBA and Con Comm. The Commission stated that they do not have any authority to handle Eugene’s complaint that he would have to take this up with the cell tower
company with which he has the agreement. It was noted that Berkshire Geo-Technologies (engineer of the drainage plans) is contracted with the cell tower company and cannot make the decision unless the tower company approves it. Chris has spoken with the tower representatives and they are in favor of a finding a cost effective solution. The Commission doesn’t have any issues with changes being made as long as the solution works.
4. Ben Krupka of Old Beartown Rd came in to update the Commission on his proposed project which he will be filing officially for the May meeting. He received permission to cut the saplings without filing in December or January. He is requesting permission to cut the big trees where his proposed house and septic will be before actually filing so that he can burn them before that season ends. Chris Tryon presented plans of what will be proposed at next month’s meeting. Chris confirmed that they will not be taking down more than 50% of the canopy and that the cutting will be below the ½ acre allowed. Ben noted that there may be 2 wells on the property as he is hoping to install a geo-thermal well. Ben also plans to install his well prior to the May meeting. Informally the
Commission had no issues with what was being asked.
5. ZBA special permit application for 16 Seven Arts: The Commission determined that the project as submitted does not fall under our jurisdiction.
