Conservation Commission Minutes 7/10/12
CONSERVATION COMMISSION
Town of Monterey, Massachusetts
                                                                        
MEETING DATE: 7/10/12
Present: Richard Andrus, Timothy Lovett, David Dempsey, Christopher Blair and Betty Pixley
The meeting convened at 6:05p.m.

Dodge – Art School Rd DEP file # 230-0255 Request for a Certificate of Compliance (R. Andrus is the project manager)
Shannon Boomsma of White Engineering was present on behalf of the Dodge’s to request a certificate of compliance.  The Commission issued a complete certification.  The Commission stated that the only thing left that needs to be done is that the silt fences need to be taken down.

Ahye – 656 Main Rd – SMA06-04 – Request for a Certificate of Compliance (R. Andrus is the project manager)
Shannon Boomsma of White Engineering was present on behalf of the Ahye’s to request a certificate of compliance.  The Commission issued a complete certification.

Reid – Sandisfield Rd – Request for an extension to existing OOC for DEP file #230-0253 (R. Andrus is the project manager)
Nick Anderson of Berkshire Engineering came in to request a 3 year extension on the existing Order of Conditions.  The Commission approved the extension for 3 years.  The new expiration date is 7/13/15.

Germain – 70 Tyringham Rd – RDA – bury a propane tank (C. Blair is the project manager)
No one was present to review the project with the Commission.  Chris had made a site visit and filled the Commission in on his observations.  Chris Tryon was present and answered some questions as his father will be doing the project.  The Commission approved the project as submitted as a N3.

Gero – 349 Main Rd – RDA – replace existing pvc drainage pipe (D. Dempsey is the project manager)
Rudy Gero was present to describe the project and answer questions.  The pipe is located between the barn and garage.  The project was unanimously approved as a N1.  

Hume Lake Christian Camps – RDA – 73 Chestnut Hill Rd – to construct a Victory Circle within the buffer zones of Stedman Pond and an intermittent stream (T. Lovett is the project manager)
Chris Tryon of Berkshire Geo-Technologies was present to review the project.  They are building a victory circle which is essentially wooden benches built on piers for performances, movies, etc.  Chris noted that there will be a lot of future work going on at the camp and more filings to follow.  The Commission approved this project as submitted as a N3.

For Discussion:
1.  Mail was reviewed.
2.  Minutes from 6.12.12 were approved as written.
3.  Susan Bachelder was present to request information regarding the right of way near 12 Laurel Banks.  She stated that 2 years ago she was given permission from the Commission to remove 4 trees to install a well and this permission will soon expire (Oct 2012).  She wanted to know if the modifications that were applied for in April of 2011 would extend the expiration date of if she’s going to need to refile.  Chris noted that RDA’s just expire and are not renewable.  The only things left to do are to replant trees but Ms. Bachelder is currently in the middle of a legal dispute with regards to this land.  The Commission asked that once the legal dispute has ended to come back and have a discussion with the Commission.
4.  The Commission reviewed their current procedure for requesting permission to cut dead trees and felt that it was working quite nicely.
5.  The Commission discussed the complaint received today about tree cutting on Seven Arts Rd.  Chris showed pictures that he took and noted that he did not feel that the work done was a violation.
