CONSERVATION COMMISSION
Town of Monterey, Massachusetts
MEETING DATE: 12/13/11
Present: Richard Andrus, Timothy Lovett, David Dempsey, and Betty Pixley
The meeting convened at 6:00p.m.
Anderson – 26 Bidwell Rd - NOI – construct raised staircase to Lake Garfield from Bidwell Rd (D. Dempsey is the project manager)
Tom Ingersoll was present to present the project to the Commission. Comments were received from DEP and the NHESP. The house is currently for sale and the current owner is looking to keep an easement for to the lake, no property lines are being changed. The Commission approved the project as submitted with the special condition that there is “no bank activity”.
Batista – 22 Hebert’s Cove Rd – RDA – elevate house above flood plain (C. Blair is the project manager)
Josh Allentuck was present to review the project with the Commission. Josh made a site visit earlier this month with Chris Blair and Chris stated that a NOI will need to be filed. The Commission issued a positive determination that the area is in an area subject to protection under the Act and removing, filling, dredging, or altering of the area requires the filing of a Notice of Intent. The house is currently on piers and has flooded three times.
Close – 10 Laurel Banks Lane – RDA – bury existing water line (R. Andrus is the project manager)
Peter Close was present to review the project. His water lines are currently above ground and he’d like to bury them below the frost line along with the electric. The project was approved as submitted as a N3 subject to the following conditions; installing silt fence and seeding.
Sweeney – 6 Bidwell Rd – RDA – remove existing dock and replace with removable one (B. Pixley is the project manager)
Mike Parsons was present along with Pam’s caretaker to present the project. This will be a removable dock by “Walk on Water” docks. The dock will be the same size as the old one as that is what Ms. Sweeney has a permit for. The project was approved as submitted as a N3.
Moriarity – 14 Hebert’s Cove – NOI – reconstruct existing house foundation and repair existing dock’s pier (C. Blair is the project manager)
Nick Anderson of Berkshire Engineering, Dan Moriarity and the Bob Olinski of the project were all present to review the project. They want to raise the house 2 feet. DEP’s comments were reviewed. The project was approved as submitted. This is also going to have to go before the Board of Appeals.
Estreicher – 605 Main Rd – RDA – construct a well road within the 100ft buffer zone of an intermittent stream for access to drill new well (D. Dempsey is the project manager)
Chris Tryon of Berkshire Geo-Technologies was present to review the project. There is an existing shallow well that keeps running out of water and came back with a high E. Coli count. The Commission approved the project as submitted as a N3. The existing well and pump house will be decommissioned.
For Discussion:
1. Mail was reviewed.
2. Minutes from 11/8/11 were approved as written.
3. The Commission reviewed and approved the “Guide to docks in Monterey” informational sheet created. This will be available at Town Hall and on the town website.
4. Dave made a site visit to the Fitzpatrick home on Tyringham Rd for work being done by Roger Tryon without a permit. He stated that the foundation work was within the buffer zone and not permitted but it is unclear what the extent of the actual work was that was being done.
