CONSERVATION COMMISSION

MEETING DATE: 10/11/11
Present: Richard Andrus, David Dempsey, Timothy Lovett and Christopher Blair
The meeting convened at 6:10p.m.

10 Point Rd – RDA – Drill new well (T. Lovett is the project manager)
Rob VanderKar of Guntlow & Associates was present to review the proposed project.  At one point there was a shared water system and currently most of those homes have gone to a drilled well and Mr. Dowd wishes to do the same.  The project as submitted was approved as a N3.

26 Bidwell Rd – RDA – Create a pedestrian access path to the lake (C. Blair is the project manager)
Peter Vallianos was present to review the proposed project with the Commission although he stated he was unprepared and unfamiliar with the plans submitted.  Peter is under the impression that Ms. Anderson wants to change the plans.  Chris spoke to Tom Ingersoll and made a site visit and summarized what he saw.  Chris informed Tom that if he plans on crossing the BVW a NOI will need to be filed but if he is going to run alongside it a RDA is sufficient.  Peter stated that if Ms. Anderson changes the plans they will come back before the Commission.  The project was approved as submitted as a N3.

151 Hupi Rd – DEP file #230-0256 - Request for Certificate of Compliance (T. Lovett is the project manager)
A site visit was made on Oct 1, 2011.  The Commission approved it as a complete certification and signed the certificate of compliance.

For Discussion:
1.  Mail was reviewed.
2.  Minutes from 9.13.11 were approved as written.
3.  Rob VanderKar inquired about the Rissman property NOI (dock and boathouse), he will be filing an amendment to the NOI (a clerical item) and he just wanted the Commission know that he would not be in attendance at that hearing since it is just a clerical item that needs to me amended.
4.  The Commission informally reviewed an email request from Kevin Roche of 90-92 Beartown Mtn Rd. to dredge the pools on their property that were filled in by the storms.  Chris spoke to Mark Stinson of DEP.  An OOC was issued in September of 2006 which has been issued a certificate of compliance.  The Commission will inform Mr. Roche that he is allowed to maintain the area but needs to inform the Commission of his intentions, including the machines to be used and when he plans to do the work.
5.  The Commission completed and signed the paperwork from last month’s meeting for 4 Art School Rd.  Betty, who was not present tonight needs to sign before it can be issued.
6.  The Commission reviewed the file for 16 Laurel Banks after a complaint was received that conditions set by the Commission in 1996 may not have been followed.  There is a deck located on the property that an Enforcement Order was issued for and that was also found to be in violation of zoning setbacks (building department’s jurisdiction).  The Commission feels that since there is a zoning violation noted here, this really falls under the enforcement of the Building Commissioner/Zoning Enforcement Officer and the ZBA to handle.  Chris will call the complainant and let her know that this issue is a Building Department matter and does not fall under the Commission’s jurisdiction.
