Conservation Commission Minutes 7/12/11
CONSERVATION COMMISSION
Town of Monterey, Massachusetts
                                                                        
MEETING DATE: 7/12/11
Present: Richard Andrus, David Dempsey and Christopher Blair
The meeting convened at 6:00p.m.

Friedman – RDA – 68 Tyringham Rd – replace an existing dock (T. Lovett is the project manager)
Mr. & Mrs. Friedman were present to review the project.  The project was approved as a N3 as submitted with no additional conditions.  There was some Q&A about replacing the bank on an additional piece of property that Mr. Friedman just purchased with a retaining wall.  The Commission advised Mr. Friedman that with the project he’s proposing he should file a NOI.

Uhlman – RDA – 190 Beartown Mtn Rd – replace an existing failed septic (D. Dempsey is the project manager)
Chris Tryon of Kelly Granger and Parsons was present to review the project.  Septic design plans were also submitted that were not with the original application.  The system will be a perc right system which is a closed loop system.  The project was approved as submitted as a N2.

Bruno – RDA – Beartown Mtn Rd – new single family home and utilities (R. Andrus is the project manager)
Chris Tryon of Kelly Granger and Parsons was present to review the project.  Rick questioned what the BVW was but Chris was unable to provide that information.  The project was approved as submitted as a N3.

Whitaker – RDA – 237 Beartown Mtn Rd – replace an existing failed septic (B. Pixley is the project manager)
Chris Tryon of Kelly Granger and Parsons was present to review the project.  There will not be a retaining wall.  The project was approved as a N3.  The current plans did not show a silt fence and the Commission stated that the updated plans should reflect the silt fence.  This house is being donated to the University of Pennsylvania.

For Discussion:
1.  Mail was reviewed.
a.  The Commission approved a $50 contribution to the BRNC.
b.  The Commission approved renewing their membership to the MACC for $108.
c.  Renewal of a simplified BRP WW12 license was reviewed for 4 Point Rd.
d.  Letter from Lycott Environmental regarding a spot treatment on Steven’s Lake under NOI #230-0250.
e.  Letter from White Engineering regarding file #230-0255 and the inspection report for the wetland replication areas.
2.  Minutes from 6/14/11 were approved as written.
3.  Chris Tryon inquired if a RDA needed to be filed for a roofing job on the house next to the river/town hall.  The Commission stated that yes a RDA should be filed especially since the project would be pretty visible.
4.  The Commission reviewed a special permit application for a cell tower to be erected at 31 Main Rd.  The Commission believes that there is a stream within the proximity of the proposed tower but the wetlands were not identified in any of the documents submitted.  The Commission also felt that Town Counsel should be contacted to find out what their authority was with regards to cell towers and our SMA and the WPA.  The Commission will respond to this at their August meeting.
5.  The Commission discussed the Levkoff project and the request received from Tom Whalen for a letter from the Commission stating that the applicant has met the requirements set by the Commission.  The file and correspondence regarding this was reviewed.  A letter will be drafted and sent with the items that have been completed and the items that still need to be completed.
