CONSERVATION COMMISSION

Present: David Dempsey, Judith Bach and Christopher Blair
The meeting convened at 6:00p.m.

Lombardo Group – RDA – 62 Worth Lane – maintain and reconstruct existing deck and add screen (T. Lovett is the project manager)
Nick DiSantis, representative for the Lombardo Group was present to review the project.  There is a 10’ x 20’ deck currently there which will be removed.  Three new sona tubes will be installed and the porch is going to be enclosed with screens.  The deck will be the same footprint but will have a roof and be enclosed.  The project was approved as a N3 and silt fence must be installed as shown on the plans.

Prusinski – RDA – Old Beartown Mtn Rd – construct a single family home with septic & well installation and SMARDA – SMA10-03 (C. Blair is the project manager)
The address was corrected from Old Beartown Mtn Rd to Old Beartown Rd (as instructed by the Director of Operations when the property’s 911 number was assigned).  Chris Tryon of Kelly, Granger and Parsons and the owner John Prusinski were present to review the project.  There is a small intermittent stream across Old Beartown Road.  The first 50-60 feet of the driveway is within the buffer zone.  All the rest of the work is outside of the 50 foot buffer.  The WPA RDA was approved as submitted as a N3.  The SMA RDA was also approved as submitted with a negative determination with no further filing necessary.

Fitzpatrick – RDA – 39 Tyringham Rd – increase size of existing deck and resurface, replace railings and stairs (D. Dempsey is the project manager)
The owner contacted the Commission earlier in the week to let them know that she is looking for a new contractor so no one will be present tonight.  The Commission opened the hearing and continued it until next month.

For Discussion:
1.  Mail was reviewed.
2.  Minutes from April were approved as written.
3.  C.W. Nelson was present to review the Determination of Applicability that was issued for the Gelbard property at 19 Lime Rock Lane which was issued in July of 2007 and will expire this July and RDA’s are not extendable.  An additional RDA will need to be filed for the work not listed in the 2007 RDA.
4.  Wayne & Shaylan Burkhart came in to talk to the Commission about Barnum Hill and reconstitute their pond which is located near Fairview Rd, behind the house near the barn.  Informally the Burkharts were here to find out how to start this process.  The Commission will research this a bit and get back to the Burkharts.
5.  Shaylan asked about some trees that have fallen across Rawson Brook on Gould Rd.  Chris stated that trees in the river are better for habitat.  It makes for better fish food.  There are times when they need to be removed (if it’s flooding a road), but all in all it’s better to leave them there.
