Conservation Commission Minutes 4/12/10
CONSERVATION COMMISSION

MEETING DATE: 4/12/10
Present: Richard Andrus, David Dempsey, Judith Bach and Christopher Blair
The meeting convened at 6:00p.m.

Krans – 29 Cronk Rd – RDA - construct a 22’ x 24’ garage (T. Lovett is the project manager)
Jacob Krans was present to review the project with the Commission.  The project was approved as submitted as a N3 subject to the following conditions: 1. excavate materials out of wetlands and 2. seed disturbed areas.  Jacob asked how he can prove to the Assessors that there are wetlands on his property.  The Conservation Commission stated that he only needs to show a copy of the engineering study that Kelly Granger and Parsons did that delineates the wetlands.

Mestel – 16 Woodland Dr – RDA - continued seasonal dock installation and removal (R. Andrus is the project manager)
Ann Bruzzi of Berkshire Engineering was present to review the project.  The legal advertisement noted that the project was at 99 Hupi Rd (as that was one address listed on the application) but the actual project is at 16 Woodland Dr.  The applicant has applied for a 30 year continued seasonal dock installation and removal license which also corrects the layout that was on the original permit.  The project was approved as submitted as a N2.  The property is actually on the land of Crotty but there is an easement.

Ehrlich – 28 Northwest Cove Rd – RDA – planting plan (D. Dempsey is the project manager)
Dennis Downing and Tom Whalen were present to review the project to install 14 hemlock trees.  The project was approved as submitted as a N3.

Mielke – Lime Rock Lane – RDA – clean up debris, restore to recreation area (C. Blair is the project manager)
Rick and Deborah Mielke were present to review their project.  The project was approved as submitted as a N2.  There are 9 properties that have a deeded access to the beach over this property which Rick stated none of them have cleaned up or maintained the property.  These owners all pay dues to a private association.  The Commission agreed to allow Rick to bring in 2 loads of sand in his truck.  The Commission noted that Rick should have made all the other deeded owners that have access to this property of his plans to clean it up.

Mandelbaum – 521 Main Rd – Extension permit request (R. Andrus is the project manager)
The Board approved the request to extend the OOC which was set to expire in April of 2010 to April of 2013.

Rothschild – 56 Sylvan Rd – RDA – install a 30’ aluminum and cedar deck dock (R. Andrus is the project manager)
No one was present to review the project with the Commission. It was approved as a N2 with the following requirements: must conform with the enclosed DEP Small Docks and Piers Guide dated November 2003 (enclosed) and shall allow lateral access at the shoreline.

For Discussion:
1.  Mail was reviewed.
2.  Mr. Johnson and his representatives were present with questions about the former Rosenthal property he purchased on Riverwood Way and his proposed septic plans.  It’s located in the riverfront area and they need to know if they need to file a new NOI.
3.  Gail Ceriesa of Berkshire Wetland Services came in to present a plan and report for Miller of 24 Carrington Battelle Rd. which was asked for by the Commission when the Enforcement Order was sent last year.
4.  The Commission reviewed the town meeting warrant article item that will be discussed at the informational meeting on 4/23/10.  Chris will attend.
