CONSERVATION COMMISSION

MEETING DATE: February 8, 2010

The meeting convened at 6:00p.m.
Raab – 547 Main Rd – RDA – set boulders near existing boathouse to control erosion (R. Andrus is the project manager)
Jerrold and Giuliana Raab were present to present the project. The soil is eroding near the boathouse and they’d like to place boulders to prevent this in the most natural way. The Commission would like to see the Raab’s plans with dimensions and such on paper before approving any work to begin. The plans will need to show that the solution will be the right one for any future conditions the site might occur. The Commission suggested that a professional will need to present the plans. The Raab’s already have the boulders and want to start moving them prior to the ground getting soft. The hearing will be continued until the March meeting unless plans are provided sooner and a special meeting can be scheduled.
Roche – Beartown Mtn Rd – Request for Certificate of Compliance (T. Lovett is the project manager)
A certificate of compliance was issued to Kevin Roche for his property on Beartown Mtn. Rd.
For Discussion:
1. Mail was reviewed.
2. Minutes from 1.11.10 were approved as written.
3. Mark Stinson of DEP was present and discussed the following with the Commission:
a. Fines collected.
b. Monterey has had one wetlands change; this is when a computer program in Boston compared aerial photographs from different years to determine any wetlands changes. The Commission reviewed the maps and determined that the property was the Tryon farm and the Commission thought that the change was probably trees that were cut.
c. Mark suggested that the Commission use some of their funds to purchase a laptop for Commission use. He stated that getting the Pictometry software would also be very helpful for the Town to have.
d. New online DEP transactions. Certain forms can now be submitted online. Mark gave a tutorial to the Commission members.
e. Questions have arisen about 50 – 100ft buffer zones and applications that are out of the 50ft buffer zone filing a RDA instead of a NOI. Chris had questions about how to handle these filings. The ANRAD exists only for locking in BVW and other wetland boundaries. The current form for the ANRAD supports this. So there is only a 100 foot Buffer Zone and it is up to the commission to determine the impacts of activities proposed in the Buffer Zone.
4. The ZBA special permit application for KSA-MASS, LLC was reviewed. The change of use does not fall under the jurisdiction of the Commission. Should any additional activities be proposed the Commission would need to review those plans.
5. An Enforcement Order was issued earlier this month for some tree cutting done in a BVW. The property was mistakenly thought to be in Monterey but the Commission was made aware that where the cutting was done the house is actually in New Marlborough but some of the property is in Monterey. The Commission gave the information to Ned Wilson of the New Marlborough Conservation Commission that was present at tonight’s meeting and will correct the enforcement order to show the right property owner.
6. The Commission discussed adding another member to the Commission. David knows someone that might be interested.
