Conservation Commission Minutes 11/9/09
CONSERVATION COMMISSION
Town of Monterey, Massachusetts
                                                                        
MEETING DATE: November 9, 2009
Present: Richard Andrus, Timothy Lovett, David Dempsey, Judith Bach and Christopher Blair
The meeting convened at 6:00p.m.

Canning – RDA – 102 Stevens Lake Rd - to place a foundation, driveway and septic system in the buffer zone of Stevens Lake (T. Lovett is the project manager)
Ben Granskog was present to review the revised plans with the Commission.  The applicant had questions as to whether or not the Town allowed 2 curb cuts for a horseshoe shaped driveway; the Commission referred the applicant to the Director of Operations regarding this.  The meeting will be continued until a future meeting for more definitive information on the proposal.

Delmolino – 527 Main Rd – RDA – repair or replace existing patio and install retaining walls (R. Andrus is the project manager)
The hearing was opened.  The applicant requested via phone on November 5th that this be continued until the December meeting.

Weiss – 53 Stevens Lake – RDA – add a master bath and bedroom to an existing home (C. Blair is the project manager)
John Dinan, representative for the Weiss’ was present to review the project.  Chris stated that after making a site visit that this project was not within the buffer zone.  The Determination of Applicability was approved as a N1.

Tryon – 445 Main Rd – RDA - to excavate for the installation of five (5) septic tanks, four (4) pump chambers, one (1) grease trap and two (2) leaching fields as well as the reconstruction of the tea room and garage in the existing footprint (D. Dempsey is the project manager)
Mike Parsons and Chris Tryon, representatives for the Tryon’s were present to review the project proposal as well as the owner Leigh Tryon.  A motion was made, seconded and approved unanimously to approve the project as submitted.  The Commission approved the project as a N2.

Fahlund – 24 Bidwell Rd. – RDA – remove 6 trees threatening a boathouse (T. Lovett is the project manager)
Mark Makuc, representative for Mr. Fahlund was present to review the project.  A motion was made, seconded and approved unanimously to approve the project as submitted.  The Commission approved the project as a N3.

For Discussion:
1.  Mail was reviewed.
2.  Minutes from 10.13.09 were approved as written.
3.  ZBA special permit application for William Carry of 29 Broderick Rd was reviewed and a response was sent to the ZBA.  Insufficient information was submitted and the Commission was unable to determine if it fell within their jurisdiction.
4.  Peter Chait came in with concerns that the septic was failing at 7 Buckingham Lane and leaching into and polluting Lake Garfield.  The Commission was given permission to enter onto Peter Chait’s property to take a look and the Board of Health will be notified.  The Commission acknowledged that they were made aware of some zoning violations on this property; the Building Inspector has informed the homeowner that he will need to go before the Zoning Board of Appeals.
5.  The Commission reviewed the details concerning the Dolber Enforcement Order.  Mr. Dolber has ignored the certified mailing sent to him.  The Commission agreed to seek Town Counsel’s help on the matter.
6.  The Smith matter was reviewed.
7.  The Kamenstein project was reviewed.
8.  Levy: Request for Certificate of Compliance; a site visit will be made this week and the Commission will come into the office to sign it.
9.  The Klingenstein project was reviewed and it was determined that a site visit will need to be made.
