Conservation Commission Minutes 2/11/08
CONSERVATION COMMISSION
Town of Monterey, Massachusetts
                                                                        
MEETING DATE: February 11, 2008
Present: Timothy Lovett, Christopher Blair and David Dempsey
The meeting convened at 6:20p.m.

Catino – 31 Sackman WayNOI #230-0245- to upgrade the septic system to conform to Title 5 and WPA standards, construct a garage and realign the driveway, stabilize the shoreline and add a deck. (R. Andrus is the project manager)
The Board opened the hearing and reviewed the documents submitted.  Shannon Boomsma of White Engineering was present to present the project as well as the Architect and owners.   The Conservation Commission informed the Engineers that in the Lake Shore District under Monterey’s Zoning Bylaws (Section IV.B) 40ft from the shoreline is considered a no build zone.  A Chapter 91 permit has been filed for the floating dock located on the property.  The comments from DEP were reviewed and the specific questions were answered by S. Boomsma.  The hearing was closed at 7pm and a motion was made and seconded to approve the project to begin after April with any conditions the following conditions:
1.      The contractor shall call Rick Andrus, project manager 72 hours before construction commences to inspect the silt fence and site conditions.
2.      The Commission is approving the project without the deck (the Commission does not believe that the deck with the stairs is allowed where it is shown).
3.      The owner or representative shall propose a planting location and plant or tall shrubs species for 2 trees to replace the trees that are being removed for bank stabilization.  This should be submitted to the Commission in writing for approval.

Ahye – 656 Main Rd
The Commission requested at their January meeting an updated drawing #03-11-06D showing the current foundation location relative to the vernal pool adjacent to the front door and a first floor elevation that ties into the side elevation.  This information was submitted to the Commission on 1/25/08 by White Engineering and Shannon Boomsma of White Engineering was on hand to discuss the responses and the updated as-built plan with the Commission.  Shannon stated that final grading and landscaping has not been done.  The Commission was satisfied with the information provided and White Engineering is going to speak with the contractor about cleaning up the depression.  Rick Andrus should be contacted to perform a site inspection when this is complete.

For Discussion:
1.      Mail was reviewed.
2.      Minutes from 1.14.08 were approved as written.
3.      John Boleng with Civil Architectural Design, representative for Seven Stones came in to discuss with the Commission the need for an Emergency Order.  John stated that the camp has been neglected for many years and a new owner is scheduled to purchase the property tomorrow (2/12/08).  John stated that every rain storm we have the situation is getting worse for the Lake Shoreline house/cottage.   The Commission issued a WPA Emergency Certification Form effective 2/12/08 and expires 3/5/08 that will allow the applicant to use a backhoe to inspect soils to jack the building and pour temporary piers to stabilize a building and remove tipping piers that failed.  A contractor has not been chosen yet but John will be overseeing the project.  Chris will perform a site inspection on 2/12/08.  John will be back next month with an NOI.  The Commission stated that a written package needed to be submitted ASAP to the Town Hall, attention Melissa Noe.
4.      Kamenstein project:  The Commission had requested information from White Engineering at their January meeting and the owner had asked that the Architect handle the request.  A response was submitted on 1/22/08.  Chris Blair will follow up.
5.      The Commission reviewed the Special Permit application for KSAMass, LLC (formerly Seven Stones) and responded to the Zoning Board of Appeals.
