CONSERVATION COMMISSION

MEETING DATE: January 14, 2008

The meeting convened at 6:00p.m.
Delmolino – 527 Main Rd – RDA – Build a removable 4’ x 25’ dock attached to existing bulkhead at NW end of Lake Front (C. Blair is the project manager)
The applicants presented their proposal to the Board. The Board approved the project as an N3 with no additional conditions. The dock will be put in the lake in the spring and removed in the fall.
Pyramid Network Services, Mt Wilcox – RDA – develop new and existing radio sites at the top of Mt Wilcox (D. Dempsey is the project manager)
David R. a representative from Motorola who is overseeing the project for the Massachusetts State Police and DCR came in to present the project to the Board. A member of the community posed questions to the representative about the beaver pond/dam and improving the road conditions there and if there are plans to place cell phone towers on the tower. The tower will be a state police tower and adding cell phone capabilities may be an option in the future. This hearing was continued until the February meeting so the Board could research exemption questions under the Wetlands Protection Act with our local DEP contact. The Board confirmed that the tower in Phase II is exempt under the Scenic Mountains Act, because it’s a replacement of an existing tower.
Pearson, 111 Chestnut Hill Rd – NOI 230-0244 – remove siltation from an existing fire pond (T. Lovett is the project manager)
Ellen Pearson came in to present the project to the Board. She spoke with an Engineer and was quoted over $20,000.00 to do the project as was presented in her NOI. Ms. Pearson is now looking into dredging less than only 100 cubic yards. The Board and Ms. Pearson reviewed and discussed the comments from DEP. The Board suggested amending the project and paperwork and resubmitting that under the current NOI. Ms. Pearson will submit documentation from the Fire Chief declaring it a fire pond.
Makuc – 129 Tyringham Rd – Request for Certificate of Compliance DEP file #230-214
The Board reviewed the Request for a Certificate of Compliance and issued a complete certification.
For Discussion:
1. Mail was reviewed.
2. Minutes from 12/10/07 were approved as written.
3. A resident came in with questions about his property and applying for an abatement on his taxes for the delineated wetlands. The Board informed the owner that he would need to hire a surveyor to go out to his property and delineate the wetlands; this is not something that the Board does.
4. The Board reviewed the Kamenstein – 18 Woodland Dr. files (WPA and SMA) to double check the information in the Order of Conditions with regards to some site pictures taken. A letter will be sent to the Engineer on file requesting the submitted drawing (#01-09-08G) to be updated showing the actual foundation position and an actual first floor elevation submitted to the Conservation Commission prior to the next meeting.
5. The Board reviewed the Ahye – 656 Main Rd. file. In reviewing the file and Order of Conditions a letter will be written requesting an updated drawing #03-11-06D showing the current foundation location relative to the vernal pool adjacent to the front door and a first floor elevation that ties into the side elevation submitted to the Conservation Commission prior to their next meeting.
6. The Board reviewed the Rothschild – 4 Brewer Circle file. A letter will be written to Robert McMahon, Architect regarding a pile of excavated fill located within the 100ft buffer zone as delineated on his drawing submitted with the RDA. The Board would like confirmation that it will be covered with plastic sheeting from the top down and fixed so it won’t blow away since it will be difficult now to move. After this has been done, Chris Blair will need to be called to perform a site inspection.
7. Chris Blair informed the Board that DEP is going to rebuilding the dam located at Benedict Pond and that they are only filing in GB.
