Minutes from Regular Conservation Commission meeting.
                                                                        
MEETING: 8 November 2004

Redlich, Doris, Point Rd      RDA                                                          Map 15, Lot 53
Project is under a Stop Work order from D Torrico because contractor Pennell did not obtain a building permit before starting work. Chris Blair inspected property and asked for an RDA to be filed. Pennell appeared with the RDA paperwork; however,  Blair had been informed by Torrico that Mrs Redlich had fired Pennell and hired contractor Don Carroll to complete the project and paperwork filing. We asked for a site plan showing the house, proposed work, nearby wetlands, and protection proposed the project. Pennell left and towards the middle of the meeting Carroll appeared. We repeated the need for a site plan described above. The Public Meeting was continued pending receipt of the site plan.

Sloane, Michael –   16 Point Road             RDA                        N3      Map 15, Lot 126
Applicant represented self. Project is 8’ x 28’ deck addition in the buffer zone. This project had been presented as an expansion of the house 1 or 2 years ago; now they are only expanding the deck. We approved the project with 3 conditions: 1) Install the silt fence as shown, 2) all disturbed areas are to be seeded and mulched, and 3) call Rick Andrus at 528-1723 to inspect the installation of the silt fence before any work is done.

Hearing opened at 6:45 pm. Waiting for copy of revised, stamped septic plan. No project proponents present. Continued until next meeting, 13 December 2004. Closed 6:50pm.

Hearing opened at 6:50 pm. No project proponents present. Continued until next meeting, 13 December 2004. Closed 6:52pm.

Reviewed paper work. Opened mail. ZBA asked us for project review and comments to be used during their deliberations. Blair to write both letters.

ZBA/Gurtman. OK to Permit; removal of asphalt is good, new septic is good, they may disturb less than 10% of Buffer Zone for the project. They will have to submit a filing with Concom to obtain a building permit.

ZBA/Nault. Addition of Garage with bedroom; dwellings stay at level of 2 bedrooms. OK to Permit; they may disturb less than 10% of Buffer Zone for the project. They will have to submit a filing with Concom to obtain a building permit.





By-Laws language. The Select Board asked us to review and submit improved language for the paragraph Section VI, Setback Requirements, note (b.): “The stated setbacks notwithstanding, no structure except fences, steps, and docks may be erected in the Lake Shore District less than forty (40) feet from the mean high water line.”

While calculating the mean high water line an applicant might use the low water line during drawdown, putting the building zone into the lake. Also because of erosion and changing shorelines, this point is being argued as being in the water by applicants.

L Garfield has a concrete dam control structure. It has two concrete ledges; no water leaves the lake when the level is below the concrete, except when the structure is open for drawdown. Water above this flows over the concrete and exits the lake. Using this as a benchmark would be easy and the information can easily be project onto the ground at a homeowner’s shoreline by a surveyor.

L Buel has no dam control structure. There is, as in L Garfield, an elevation number used by the USGS on their published topographic maps. Maybe the boat ramp has an elevation marker. We will discuss this further.
