MONSON ZONING BOARD OF APPEALS
MINUTES JULY 24, 2014

MEMBERS PRESENT: David Beaudoin, Frank Carey, Ronald Fussell and Tere Hrynkiw.

MEMBERS ABSENT:  David Jarvis and John Martin

Chairman David Beaudoin convened the meeting.

Frank Carey moved to accept the minutes of June 26, 2014 with a correction to a typographical error on Page 2 it should read “a 24’ x 40’ single family home”.

Ronald Fussell seconded the motion.

It was so voted, unanimous.

7:45 Public Hearing for Catherine Jurczyk, David LaPrad and Janet Platt to appeal a decision of the Zoning Enforcement Officer regarding the re-construction of a single family home on a non-conforming lot.  The applicant is appealing the denial of a Building Permit by the Monson Building Commission under Section 3.3.5 of the Monson Zoning Bylaws.

Frank Carey read the legal notice for the public hearing advertised in the Republican Newspaper the weeks of July 10, & 17, 2014, Case # D-2014.

Following comments from the Chairman regarding the purpose of the Zoning Board of Appeals, the time constraints the Board must meet to hold a hearing and issue a decision, and the manner in which the hearing would be conducted, David Beaudoin introduced the four (4) members present.  He stated that normally five (5) members of the Board vote on a petition but due to vacation and work commitments two (2) members were absent.  Of the four (4) members present all four must vote to overturn the decision of the Building Commissioner in order for the appeal to be successful, if one member votes to uphold the decision of the Building Commissioner the appeal would not be granted.  If five (5) members were present and four (4) members voted to overturn the decision of the Building Commissioner, the appeal would be granted.  He questioned if the petitioners wanted to go forward with four (4) members or continue the hearing to August 28, 2014 in order to have five (5) members present?  

Speaking on behalf of the petitioners Janet Platt stated they would continue the hearing.

The petitioners made a written request to continue the public hearing to appeal a decision of the Monson Building Commissioner to August 28, 2014 at 7:45 P.M.

Ronald Fussell moved to continue the public hearing as requested.

Tere Hrynkiw seconded the motion.

It was so voted, unanimous.

8:15 Ronald Fussell moved to adjourn.

Frank Carey seconded the motion.

It was so voted, unanimous.
