Minutes of meeting July 26, 2012

Members Present: Frank Carey, John Martin, Ronald Fussell, David Beaudoin and Scott O’Neil.

Members Absent: Tere Hrynkiw and David Jarvis.

Continuation of public hearing for Quaboag Riders, 31 King Avenue to appeal a decision of the Zoning Enforcement Order, Case No: C – 2012.

Atty. Ray Blanchette entered a letter from an abutter Gary Pfisterer showing use of the property during his ownership that continues to this date.  A copy of an enlarged assessors map indicating the location of the club house and current track layout indicating distance from abutters was submitted.  An aerial photograph from 1994 was shown to demonstrate the power line easement that is no longer in use.

Frank Carey requested the delineations of the exact distances from abutters.

Atty. Blanchette requested clarification on the distance from abutters that would meet the requirements of the Board on ruling on the appeal with the potential grant of a special permit.

The Board reviewed the action of the Zoning Enforcement Officer.

Ronald Fussell moved to act on the appeal.

Ronald Fussell, Frank Carey, John Martin and David Beaudoin voted to deny the appeal.

Scott O’Neil voted to uphold the appeal.

Atty. Blanchette submitted under Section 3.3.2 (2) that the Board issue a special permit to allow the use with conditions.

John Martin made a motion to allow the modification of the submission.

Ronald Fussell seconded the motion.

It was so voted unanimous.
David Beaudoin moved to vote on a Special Permit with conditions.

Ronald Fussell seconded the motion.

It was so voted unanimous.

Voting: David Beaudoin, Frank Carey, Ronald Fussell, John Martin and Scott O’Neil.

Conditions:

  • No changes shall be made to the track layout that enters into a 250 foot buffer zone to abutters.
  • Public safety coverage shall be provided as requested by the Monson Public Safety Officials for all races.
  • No race shall begin any earlier than 9:00 A.M.
  • The Special Permit may be subject to review within two (2) years from issuance at the option of the issuing Board solely for compliance with the Special Permit conditions stated herein.
