MONSON ZONING BOARD OF APPEALS
MINUTES JULY 28, 2011

MEMBERS PRESENT: David Beaudoin, Frank Carey, John Martin, Tere Hrynkiw, Ron Fussell

MEMBERS ABSENT:  David Jarvis and Scott O’Neill

7:30 P.M. Chairman David Beaudoin convened the meeting and the Board signed the bill schedule.

Frank Carey moved to accept the minutes with a correction to a typographical error 2001 should be 2011.

Tere Hrynkiw seconded the motion.

It was so voted unanimous.

The Board received a request from Robert North/Kevin Byrnes to extend the Special Permit for earth removal for one year.

Frank Carey stated he did not see a problem with extending the permit for one year with all of the original conditions imposed in the Board’s decision remaining in effect.

Dave Beaudoin agreed.

Frank Carey moved to grant a one year extension for the Special Permit for earth removal on Bethany Road Case E – 2010 with all of the conditions contained in the Board’s decision dated August 2010 remaining in effect.

John Martin seconded the motion.

It was so voted unanimous.

7:55 Continuation of a public hearing for Joan & Richard Sabadosa 269 Hovey Road, requesting a special permit for an in-law apartment.  The hearing has been continued on a monthly basis since April at the request of the applicants to allow time for them to secure additional information requested by the Board.  The applicants have submitted a written request dated July 28, 2011 requesting another on month continuance to August 25, 2011.  

David Beaudoin stated the applicants indicated in the letter that they are waiting for documents from Sherman & Frydryk.   In view of the tornado and the probable demand for Sherman & Frydryk’s services Mr. Beaudoin recommended that the Board grant another continuance for one month and send a letter to the applicant that the Board will not grant a further continuance.  If the applicants do not have the information in time for the meeting of August 25, 2011 they have the option of withdrawing without prejudice (this would allow them to re-file the same information within two years) or to proceed with the hearing with the documentation that has already been submitted.  If the Board should deny the special permit the applicants would have to wait two years before filing again.  Mr. Beaudoin apologized to the abutters that were present for the hearing and stated the Board did not have notice of the continuance until today and that left no time to notify interested parties.

Frank Carey stated he agreed with Mr. Beaudoin and would make a motion to grant a continuance to August 25, 2011 with the understanding that the Board would not grant further continuances.  

Ronald Fussell seconded the motion.

It was voted unanimous.

8:30 Tere Hrynkiw moved to adjourn.

Frank Carey seconded the motion.

It was so voted unanimous.
