MINUTES NOVEMBER 18, 2010

MEMBERS PRESENT:  David Beaudoin, Kevin Biermann, David Jarvis, Frank Carey, Tere Hrynkiw, John Martin, and Scott O’Neill.

ALSO PRESENT:  Ronald Fussell

Chairman David Beaudoin convened the meeting at 7:30 P.M. and the Board signed the bill schedule.

Kevin Biermann moved to accept the minutes of the September 16, 2010 meeting as presented.

Tere Hrynkiw seconded the motion.

It was so voted unanimous.

7:50 The Board discussed Section 3.3 Non Conforming Uses and Structures of the Monson Zoning Bylaws, particularly when a variance is required versus a finding by the Building Commissioner.  Section 3.3.4 deals with the reconstruction, extension or structural change of a non conforming structure including the extension of an exterior wall at or along the same non conforming distance and states for all structures other than single and two-family residential structures a variance shall be required from the Zoning Board of Appeals.  Section 3.3.5 of the Bylaws identifies alterations to  non conforming single and two family residential structures that may be reconstructed, extended, altered, or structurally changed after a determination by the Building Commissioner that the proposed reconstruction, alteration or extension does not increase the non conforming nature of the structure.

The discussion centered on a property located on Cedar Swamp Road that has a non-conforming accessory structure the property owner would like to reconstruct and enlarge.  Based on the review of the bylaws it would appear that the property owner should apply for a variance.

8:20  Frank Carey moved to change the regularly scheduled December meeting from December 23, 2010 to December 16, 2010.  

Tere Hrynkiw seconded the motion.
