MONSON ZONING BOARD OF APPEALS
MINUTES APRIL 22, 2010
MEMBERS PRESENT: David Beaudoin, Frank Carey, Kevin Biermann, David Jarvis and Scot O’Neill.
MEMBERS ABSENT: Tere Hrynkiw
7:30 Chairman David Beaudoin convened the meeting.
Kevin Biermann moved to accept the minutes of March 22, 2010 as presented.
Frank Carey seconded the motion.
It was so voted.
Voting aye: Kevin Biermann, David Beaudoin, Frank Carey and Scott O’Neill.
David Jarvis abstained.
Frank Carey moved to change the date of the May meeting to May 20, 2010 because of the Memorial Day holiday.
David Jarvis seconded the motion.
It was so voted unanimous.
7:45 Continuation of a Public Hearing for Thomas Pratt, Trustee of the Buckwell Property Trust for a Special Permit as provided by Section 3.1 to convert the first and second floor of an existing workshop/storage building into living quarters.
Atty. Raymond Blanchette was present representing the applicant. Also present was Gary Pfisterer.
The Chairman explained to Atty. Blanchette that Ms. Hrynkiw had left a message that she was unavoidably detained at work and would not be able to be present at the hearing. He reviewed the options available to Atty. Blanchette:
- Kevin Biermann had read the minutes of the public hearing that was held on February 25, 2010 and reviewed the documentation submitted by the applicant. Mr. Biermann would submit a sworn statement that after studying the documentation and minutes he felt confident that he would be able to vote in a knowledgeable and fair manner.
- Atty. Blanchette could go forward with the hearing this evening with the four members of the Board who were present at the meeting of February 25, 2010. In which case if the Board voted this evening all four members would have to vote to grant the special permit, a three to one vote would mean the special permit was denied.
- Atty. Blanchette could request a continuation of the public hearing to the next meeting scheduled for Thursday May 20, 2010 when it was anticipated all five members who were at the February 25, 2010 meeting would be present.
Atty. Blanchette requested a continuation of the public hearing to Thursday May 20, 2010 at 7:45 P.M.
Frank Carey moved to grant the request for a continuation.
David Jarvis seconded the motion.
It was so voted unanimous.
8:10 David Beaudoin convened a Public Hearing for Green Valley Oil for a Special Permit as provided by Section 5.3.6 & 7.3 and Variances from the requirements of Sections 3.1 Table 2 Dimensional & Density Regulations and Section 5.3.4.2 of the Monson Zoning Bylaws for property located at 27 Palmer Road, Monson owned by Leemilts Petroleum, Inc.
The Board received a written request from Lucien DiStefano, Bohler Engineering on behalf of his client Green Valley Oil to continue the public hearing to the next available date in May.
Kevin Biermann moved to continue the hearing to May 20, 2010 at 8:00 P.M.
David Jarvis seconded the motion.
It was so voted unanimous.
Frank Carey moved to adjourn at 8:15 P.M.
