MONSON PLANNING BOARD
MINUTES AUGUST 17, 2010
MEMBERS PRESENT: Craig Sweitzer, Paul Hatch, Kevin Haley and Karen King.
MEMBERS ABSENT: Tara Hengeveld.
7:00 The Board reviewed a plan submitted by Kevin Byrne 20 Chestnut Street showing a division of property creating a single family building lot and the remaining land to become an integral part of his property at 20 Chestnut Street. The plan shows an accessory building that is 28 feet from the lot line. Following review the Board withheld endorsement until a revised plan could be submitted to the Board with specific language stating the existing accessory building at 20 Chestnut Street would not be used to house animals. The Schedule of Use Regulations Table 1 of the Zoning Bylaws states that no accessory building for the housing of animals is allowed within 75 feet of any lot line.
A representative of Juliano Pools and the property owner of 7 Heritage Lane met with the Board to discuss the Water Supply Protection District bylaw and its impacts on the installation of an in ground pool on the property.
The Board reviewed the bylaw stating any use of the property that will render impervious more than 15% or 2500 square feet of any lot whichever is greater requires a special permit. If Mr. Robert intends to install an in-ground pool he will have to file for a Special Permit and demonstrate how he will accomplish the water recharge.
Paul Hatch stated a drywell is not necessarily the best choice. An infiltrator is better for maintenance purposes; it is smaller than a drywell and will take up less space to get the same amount of water into the ground.
Harold Leaming, Building Commission stated the documentation submitted with the application should be stamped and signed by an engineer.
Paul Hatch stated the Board would also require a copy of the calculations.
The Board reviewed a draft of the solar energy bylaw with discussion mostly centering upon how to designate locations, an overlay district versus designation by land size.
Paul Hatch stated if the Board goes with land size the acreage must be contiguous.
Kevin Haley suggested 50 contiguous acres in any zoning district.
Harold Leaming stated in discussions with Cornerstone Development one of the elements they look for is transmissions lines through or abutting the property.
Paul Hatch suggested any parcel of land containing 50 contiguous acres that is crossed by transmission lines or has transmission lines abutting the property.
The Board asked the Clerk to research the definition of “transmission lines”.
8:25 Karen King moved to accept the minutes of July 20, 2010 as presented.
Craig Sweitzer seconded the motion.
