Conservation Commission Minutes 10/08/2014
MONSON CONSERVATION COMMISSION
MINUTES OCTOBER 8, 2014

MEMBERS PRESENT:  Glenn Colburn, Leslie Duthie and Davis Johnson.

7:00  The Commission were notified by the Board of Health of a problem on Route 32 near the railroad crossing caused by a beaver impoundment.  MassDOT was on the scene and removed three inches of the dam to prevent the water from flooding Route 32.

The Commission expected to hear from Mr. Guthrie, 241 Silver Street regarding a consultant.  Leslie Duthie stated she would send a letter if the Commission does not hear anything within the next few days.

The Commission signed the Order of Conditions for William Jahn, 20 Zuell Road.    

Glenn Colburn stated it would be helpful if consultants when filing a Notice of Intent with the Conservation Commission would send a digital copy that way the Commissioners would not have to come into the office before the meeting.

7:30 NOI Lot 39 Heritage Lane Sergey Savonin.  The Commission received a written request from Peter Levesque to continue the public hearing.  Mr. Savonin hired an engineer to respond to Donald Frydryks’ review of the slope stabilization at the rear of the proposed residence.

Leslie Duthie moved to continue the public hearing to October 29, 2014 at 7:15 P.M.

David Jarvis seconded the motion.

It was so voted unanimous.

Leslie Duthie moved to accept the minutes of September 17, 2014 as presented.

Glenn Colburn seconded the motion.

It was so voted unanimous.  

7:40  The Commission received information from Andrea Agostino, National Grid that there are problems with the access they proposed to use on Palmer Road for the transmission line upgrade.  The previously proposed access does not allow for the large pieces of equipment they need to move into position and they have to change the point of access.  This will mean more disturbance in a wetland area and she would like to meet with the Commission to discuss amending the Order of Conditions previously issued.

Glenn Colburn stated he thought the best course of action was for the Commission to contact National Grid and arrange a site visit.

Leslie Duthie stated Paul Sullivan spoke with her regarding the duck race that is held each year at Summerfest in the Chicopee Brook.  Mr. Sullivan would like to prune the tree branches along the bank so that everyone can see the ducks going down the river.  He proposed to use a weed whacker to prune the branches.

Leslie Duthie stated she told Mr. Sullivan that he could not use a weed whacker or remove trees. The pruning would have to be done by hand.

Davis Johnson stated he believed this was a slippery slope that could be misconstrued by anyone wanting to cut in a wetland area without a filing.  Mr. Sullivan should file an RDA and be specific and where and what he wanted to cut.

Leslie Duthie stated Randy Pascale contacted her to discuss cutting spruce trees on his property.  Leslie Duthie stated she asked Mr. Pascale to file.

8:05 MAIL

  • Eric Ronstrum received the Order of Condition for Exxon Pipeline.
  • 60 Lower Hampden Road Walter McLaughlan received a friendly Enforcement Order.
  • Cutting Plan for Timothy Marquis 49 Stafford Road, 21 acres.
  • Cutting Plan extension Cheryl Pereira 269 Hovey Road 37 acres.
  • Copies of beaver permits for Bunyan Road Bridge and Hospital Road.
  • 155 Brimfield Road as Built Plan for Jose Martinez.
Leslie Duthie stated she look at the property and the replication work has been completed and seeded.

  • Copy of the monitoring report for Peaked Mountain, Trustees of Reservations.
Leslie Duthie stated she walked a portion of the Peaked Mountain property with the Trustees and there is a mountain bike trail marked with tape on the Trustees property.  The land abuts property owned by Joseph Dasco whose Conservation Restriction allows him to have a trail on his property for the use of his family but does not give permission for a third party to do so.  The trail that has been marked out on the Trustees property is marked with the same tape and in a similar fashion as the trail on Mr. Dasco’s property.  It appears as though a bike trail has encroached onto the Trustees land and that is a violation of the Conservation Restriction.  This is also rare species habitat.

It was the consensus of the Commission to contact Mr. Dasco and ask him to attend a Conservation Commission meeting.
Leslie Duthie stated she would send a letter to Mr. Dasco, Bradway Road, Mr. Guthrie Silver Street and Mr.  & Mrs. Fortier Lower Hampden Road.

8:25 Leslie Duthie moved to adjourn.

Davis Johnson seconded the motion.

It was so voted, unanimous.
