MONSON CONSERVATION COMMISSION
MINUTES OCTOBER 28, 2015
MEMBERS PRESENT: Glenn Colburn, Leslie Duthie and Davis Johnson.

7:00 Leslie Duthie stated Walter McLaughlan 60 Lower Hampden Road requested a Certificate of Compliance for the wetland restoration along his driveway.  Ms. Duthie stated she made a site visit and it appears that the area is restoring.  She moved to give a complete Certificate of Compliance for 60 Lower Hampden Road.

Glenn Colburn seconded the motion.

It was so voted, unanimous.

Leslie Duthie stated the Order of Conditions for Lot 6 Upper Hampden Road was ready for signature, special conditions included a pre-construction site visit once the erosion control has been installed and before any work begins; the silt fence and hay bales will completely surround the excavation area and a sweep will be conducted by a wildlife biologist prior to the start of work to prohibit a take of rare species; the hay bales and or silt fence will be replaced at the driveway entrance at the close of work each day; permanent cement bounds will be located at the building envelope in sufficient locations to make it possible to identify the permanent work limit and an Oak tree has been identified as an important resource on this lot and the Commission asks that significant care be taken around the marked Oak tree to prevent cutting or filling of soils from the root zone.  


Leslie Duthie stated there is a grant available to support active habitat management of conserved lands with a goal to expand recreation opportunities and to manage habitats for species of greatest conservation needs.  Leslie Duthie stated she believed this grant would be perfect for the management of the conservation land on Carpenter Road.  There is no match commitment, the applicant can get up to $50,000 but the grant application must be submitted no later than November 30, 2015.
7:15 NOI 354 Main Street Levesque Properties, Inc. continued.  

Donald Frydryk stated since the last meeting they received initial comments from David Loring, Tighe & Bond, addressed those concerns and have received Mr. Loring responses mostly related to drainage.

Donald Frydryk stated on the original plan part of the drainage system included sediment basins, they are more forebays and have been identified as such on the revised plan.  The plan also clarifies the surface treatment and sewer connections.  A long term operation and management plan has been prepared and there will be no stock piling of snow on the site that does not come from the site.

Leslie Duthie stated the infiltration basins must be inspected following every major storm for the first six (6) months, then twice per year.

Donald Frydryk stated the sediment forebays should be inspected once every two months.  They are shallow but have the same holding capacity as a more compact deeper basin and have sediment pads to more easily identify how much sediment is in the basin.  

Jim Haynes, Wales Road stated at one time there was a pond on the property because William Jurczyk was deeded rights to water his cows out of the pond.  

Leslie Duthie stated she was comfortable with the project and moved to close the hearing and issue an Order of Conditions.

Glenn Colburn seconded the motion.

It was so voted, unanimous.

7:45  RFD 19 Cushman Street, Joseph Metcalfe.

Glenn Colburn stated the Commission believes that the fill and grading that occurred in a 3 acre hay field owned by James Metcalfe was a violation of the Wetland Protection Act.  Mark Stinson DEP ruled that the activity qualifies for an agriculture exemption because the field is used for agricultural purpose.

Leslie Duthie stated it is work in a wetland.

Glenn Colburn moved to give a negative determination #5 the area described is subject to protection under the Act. Since the work described meets the requirements of normal maintenance for agriculture no Notice of Intent is required.

Leslie Duthie seconded the motion.

It was so voted, unanimous.

Davis Johnson moved to approve the minutes of October 7, 2015 as presented.

Leslie Duthie seconded the motion.

Glenn Colburn stated he looked on Google earth at 68 Fenton Road but did not see any wetlands and it is not riverfront area.  If there are violations on the property it is not within the jurisdiction of the Conservation Commission.  

Leslie Duthie updated the Commission on the kiosk and signs for the Flynt Quarry conservation area.  There are signs that alert the public that the site has natural features use at your own risk.  

8:00 Leslie Duthie moved to adjourn.

Davis Johnson seconded the motion.

It was so voted, unanimous.
