MONSON CONSERVATION COMMISSION
MINUTES JUNE 24, 2015

MEMBERS PRESENT: Glenn Colburn and Leslie Duthie.

MEMBERS ABSENT:  Davis Johnson.

7:00 Leslie Duthie stated she received call from a Mickey Lessard who would like to make a stone circle on the Conservation land on Silver Street, (formerly Allard property).

Glenn Colburn stated he did not see a problem with having that down near the pond but the stones could not be taken from the stone wall, no digging, nothing hanging on the trees and no wind chimes.  

Leslie Duthie stated she would get back to her and see if she was available to meet with the Commission on Tuesday July 14, to look at the site and discuss her plans.
Glenn Colburn stated parking was a problem there, it would be a good idea to try and make an area for parking.

Leslie Duthie moved to accept the minutes of June 3, 2015.

Glenn Colburn seconded.

It was so voted, unanimous.

7:15 The Commission signed the Determination of Applicability for 175 State Avenue Division of Capital Asset Management & Maintenance (Monson Developmental Center).  The Commission approved the wetland delineation to determine the ability to cap an existing land fill and issued a positive determination for an area subject to protection under the Act, removing, filling, dredging or altering the area requires the filing of a Notice of Intent.

Glenn Colburn stated he had revised the letter as suggested by the Commission for Robert Sanderson, Thayer Road.

7:20 NOI 3 Pond Road, Cheryl Medvetsky, construction of a barn within the buffer zone.

Glenn Colburn explained to Ms. Medvetsky that the Commission received an e-mail from Mark Farrell, Green Hill Engineering requesting a continuation to the July 15, 2015 meeting to give the Commission time to review a new plan that he was in the process of preparing.

Leslie Duthie stated Mark Farrell was going to mail the plan, the Commission would review it and make a site visit.  She questioned if Ms. Medvetsky would like to arrange the site visit now?

The Commission set a site visit for Tuesday July 14, 2015 at 4:30 – 5:00 P.M.

The Commission signed a Certificate of Compliance for 56 Margaret Street, Aimee Walat, and a partial Certificate of Compliance for 155 Brimfield Road, Adelina Martinez.  The replication work at 155 Brimfield Road required by the Commission is complete, but there is one more lot remaining, and that is why the Commission issued a partial certification.

Silver Street, Gale Howard.  The Commission discussed the e-mail from Mark Stimson, and Glenn Colburn related the conversation he had with him.   The Commission decided to issue a new enforcement order for the removal of fill in the wetlands and stabilization of the bank, and to require the filing of a Notice of Intent for the other work.

7:45  RFD 134 Palmer Road Massachusetts Electric Company d/b/a National Grid, property owned by William W. Jurczyk, Inc.  Kate Wilkins, Tighe & Bond was present representing Massachusetts Electric Co.

Kate Wilkins stated Mass Electric submitted the request because a portion of a proposed pavement resurfacing project at 134 Palmer Road is within the 200 foot Riverfront resource area and the 100 foot Buffer zone of a Bordering Vegetated Wetland.  The project involves milling and repaving sections of the existing paved parking areas totaling approximately 72,638 square feet.  There is no increase in impervious surface and no stockpiling of materials is anticipated on site.  Previously paved areas at the southwest corner of the property where a truck garage stands and at the southwest corner where transformers are stored will not be repaved.

Glenn Colburn questioned if there were any culverts in the project?

Kate Wilkins stated the project does not involve any culverts just milling and repaving.

Leslie Duthie questioned the erosion controls?

Kate Wilkins stated straw wattles will be installed along the top of the slope between the down gradient wetland and the work area.

Leslie Duthie stated it would appear the area behind the garage gets some activity.  She questioned what was proposed to protect the existing culverts?

Kate Wilkins stated they were not doing any work on culverts, and as they are raised the work will not impact them.

Leslie Duthie stated the Determination will include a condition that the culverts are cleaned after the repaving.  

Glenn Colburn stated it would be a good idea to protect the culverts with filter fabric while the work is ongoing.

Leslie Duthie moved to give a negative determination for work in an area subject to protection under the Act that will not dredge, alter or fill the area and with erosion controls in place does not require the filing of a Notice of Intent.

Glenn Colburn seconded the motion.

It was so voted unanimous.

8:15 The Commission reviewed the paperwork submitted by Sergey Savonin for a Certificate of Compliance on Lots 36 & 37 Heritage Lane.

Leslie Duthie stated the plans were not adequate they failed to show the permanent monuments, wetland buffer zones, the pond, work limit line and a narrative was not included explaining how the completed work differed from what was proposed, if indeed it did.  Ms. Duthie stated the plan does not match the deed notation that was submitted and the contours of the land do not appear to match.


Glenn Colburn stated the “as built” plan looks more like something for a new house “as built”, not a wetlands “as built”.  Glenn Colburn asked for the plans to be returned to the applicant and to request plans that accurately depict the existing conditions on the property.

Leslie Duthie stated she was still working on the Skorupski/Moore property on Silver Street and hoped to close on Monday June 29, 2015.  Michael Moore has asked if hunting on the property could be restricted to bow hunting.  Leslie Duthie stated she told him the Commission would have no problem with that if he would monitor it and would “sign” it.

8:30 Leslie Duthie moved to adjourn.

Glenn Colburn seconded the motion.

It was so voted, unanimous.
