MONSON CONSERVATION COMMISSION
MINUTES JUNE 13, 2012

MEMBERS PRESENT:  Glenn Colburn, Leslie Duthie and Davis Johnson.

MEMBERS ABSENT:  Audra Staples,

7:00 Quaboag Riders Club 9 King Avenue.  Ray Mansfield met informally with the Commission on behalf of the Quaboag Riders Club to discuss the Notice of Intent that the Club must file.

Mr. Mansfield stated he questioned if the stream was an intermittent or perennial stream?  

Glenn Colburn stated judging by what the Commission observed at the site visit he would classify it as an intermittent stream.

Ray Mansfield questioned if any portion of the work could be treated as a limited project?

Glenn Colburn stated no.

Ray Mansfield stated there is a small amount of Bordering Vegetated Wetland (BVW) to the east is that the only resource area that should be marked on the application?

Leslie Duthie stated the intermittent stream should be marked as bank, an intermittent stream does not qualify as riverfront area and it only has bank on one side.  Measure the disturbance on one side of the bank.  The resource areas are BVW and Bank.  

Ray Mansfield questioned if a copy of the NOI should be sent to Natural Heritage & Endangered Species Program?

Leslie Duthie stated yes.

Ray Mansfield questioned what it meant by method of identifying BVW?

Leslie Duthie explained that BVW can be identified by soil (for example taking a sample to determine if it is hydric or not) or by the vegetation that is prevalent.   

Mr. Mansfield had several other questions that the Commission did its best to answer.  

7:45  RFD 73 Carpenter Road, Angela Talbot and Marc Lefebvre.  Mr. Lefebvre stated they would like to construct a shed on their property and had one or two sites in mind.  The dilemma is that the tornado has changed the landscape of the property and where there were trees now there is water flowing things look so different.  

Leslie Duthie stated before the tornado she would have agreed that site #1 was the best site but now because of the change in the vegetation she was not so sure.

Glenn Colburn stated he thought it was run off coming from the hill.  

Davis Johnson questioned if there were any vegetation indicators?

Leslie Duthie stated it is difficult to know exactly what is going on now but after looking at the site thought that the area that was stumped and cleared and labeled #2 on the plan was a better location for the shed.

Glenn Colburn agreed with Ms. Duthie.  

Leslie Duthie moved to give a positive determination for the area that is subject to protection under the Wetland Protection Act, and a negative determination for the proposed work that will not alter, fill, or dredge an area subject to protection and does not require the filing of a Notice of Intent.

Glenn Colburn seconded the motion with a condition that the shed be located on site #2 shown on the plan.

It was so voted unanimous.

8:10 David Chapdelaine and Daniel Moran met informally with the Commission to discuss proposed renovations at 103 Lakeside Drive.  

The Commission stated it reviewed a copy of the minutes of a meeting held in 2011 where it discussed this project with Mr. Chapdelaine and would hold its position that the work required the filing of a Request for Determination (RFD).  The next meeting of the Commission is July 18, 2012.

Mr. Chapdelaine questioned if the Commission would object to interior work at the house before the next meeting?

The Commission stated it would have no objection to interior work starting before a determination was issued.  

Audra Staples stated she checked the site at 43 Waid Road proposed for construction of a shed and found no problems with it.  

Leslie Duthie moved to accept the minutes of May 23, 2012 with the addition of a question mark at the end of the sentence at the top of Page 3.

Glenn Colburn seconded the motion.

It was so voted unanimous.  

268 Palmer Road Raymond Lavallee, Ray’s Mobile Home Park.  The Enforcement Orders there were mailed by certified mail to the Mobile Home Park and to Mr. Lavallee’s private residence in Ludlow were returned unclaimed.  

Leslie Duthie stated she would wait to hear from Karen Hirschberger, DEP before mailing another Enforcement Order.

Davis Johnson informed the Commission that the property owners around Pulpit Rock Lake now own the dams.  The abutters have taken over responsibility as they would have liability whether they owned them or not and this way they have more control and can address problems easier and quicker.  

8:40 MAIL

  • Final cutting plan 10 acres for Clifford Fisher T Peck Road.
  • Final cutting plan 22.8 acres Bergeron, Paradise Lake Road.
  • Forest cutting plan 1 ½ acres Adam Channing, Upper Hampden Road, tornado clean up.
  • Final cutting plan 9 acres Harry Courniotes, T Peck Road.
  • Final cutting plan 40+ acres John Goodrich, Waid Road.
  • Review from NHESP for Upper Hampden Road, Adam Channing the proposed work does not result in a take of habitat of endangered species.
  • Forest cutting plan 23 acres Clifford Kruger, Lower Hampden Road.
  • Copy of a filing with NHESP to from Jack Carter, Cote Road to extend project conditions to March 31, 2013 for further work no stumping.
  • Report of APR inspection of property owned by Conservation Commission on Ely Road.  The report identified two acres of former pasture that is overgrown and under utilized.
  • Copy of Trust for Public Lands.
  • Copy of Lake & Pond Association.

8:50 Glenn Colburn moved to adjourn.

Davis Johnson seconded the motion.

It was so voted unanimous.
