Conservation Commission Minutes 10/20/2010










MONSON CONSERVATION COMMISSION
OCTOBER 20, 2010

MEMBERS PRESENT: Leslie Duthie, Glenn Colburn, Derek Strahan and Davis Johnson.

7:10  203 Wales Road Gary Scott Request for Certificate of Compliance.  Leslie Duthie stated she looked at the site and at the Order of Conditions.  The culvert has been installed with an invert to maintain a certain level.  Mr. Scott submitted a copy of the plan for the original Notice of Intent and it does appear that it is substantially in compliance.

Leslie Duthie moved to issue a Certificate of Compliance for the work associated with the installation of a driveway to a single family home.

Glenn Colburn seconded the motion.

It was so voted unanimous.

7:20  RFD Michael Keogh, 11 Carpenter Road. Mr. Keogh was present at the meeting and stated he is replacing his septic system.  It is proposed to excavate the existing system and put a new system in almost the same location. The plan shows the work is completely enclosed with silt fencing.  

Leslie Duthie stated the plans filed with the Conservation Commission shows Mr. Keogh’s property is completely within priority habitat.  Ms. Duthie stated she called the engineer who prepared the plans and filing to determine if a copy had been sent to the Natural Heritage and Endangered Species Program and found that it had not.  

Mr. Keough questioned how his property became habitat?

Glenn Colburn stated the NHESP determines the range of identified species and creates a map showing the habitat areas.  Each community receives a copy of the map showing the habitat areas within their Town, and the map is updated every couple of years or so.  Mr. Colburn stated this is a simple project within an existing yard it should not be a problem.

Leslie Duthie questioned if there would be stock piles of material within the enclosed work area?  

Mr. Keough stated yes.

Leslie Duthie stated that is the kind of information that must be given to NHESP.  She questioned if the Commissioners had any problems other than the filing with NHESP?

Glenn Colburn stated he had no concerns other than filing with NHESP.

Leslie Duthie moved to continue the meeting to wait for NHESP.

Glenn Colburn seconded the motion.

It was so voted unanimous.

7:40 The Commission signed the Order of Conditions for property on East Hill Road owned by Kimberly Koran.  The Special Conditions include the stone wall in the northeast corner of the lot shall serve as the permanent work limit line; all permanent boundary markers shall be in place and approved by the Monson Conservation Commission before any work commences and an “As Built” plan shall be submitted with a request for a Certificate of Compliance at the completion of the work.  

7:45  NOI Lower Hampden Road, Arthur Stone.  The Commission had continued the hearing until it received notice from NHESP that it had finished its review of the project.   The Commission received a letter dated October 4, 2010 from NHESP stating that the project could go forward with the following conditions:

  • All work shall conform to the layout shown on the plan dated 3/28/2008, revised 8/18/2010.  The total area of disturbance shall not exceed 12,000 square feet.
  • Prior to the start of any work the applicant shall submit a Wood Turtle Protection Plan prepared by a qualified Wood Turtle biologist to NHESP.  Plan from biologist wood turtle protections plan
Leslie Duthie moved to close the hearing and issue an Order of Conditions that include NHESP conditions.

Derek Strahan seconded the motion.

It was so voted unanimous.

Leslie Duthie moved to accept the minutes of September 29, 2010 as presented.

Derek Strahan seconded the motion.

It was so voted by majority vote.

Voting Aye:  Leslie Duthie, Glenn Colburn and Derek Strahan.

Davis Johnson abstained, as he was absent from the meeting.

Davis Johnson moved to accept the minutes of the meeting held on September 8, 2010.

8:10 Leslie Duthie showed the Commissioners a copy of the Monson Assessors map showing the land in Monson owned by the Wilbraham Land Trust.  The Trust has only one member and he would like to donate the land in Monson to the Monson Conservation Commission.  He has already donated the Trust land in Wilbraham to the Wilbraham Conservation Commission.  

The Commissioners agreed to accept the land that is located on Lemon Road.

Leslie Duthie stated she would contact the gentleman to let him know the Commission will accept the land.  

8:20  MAIL

  • Paul Hatch 57 Munn Road received his Determination of Applicability.
  • Copy of Lycott Environmental’s summary report regarding Paradise Lake.
A spring aquatic vegetation survey on April 28, 2010 found stonewort; fern leaf; ribbon leaf pondweed; and filamentous algae throughout the lake in light abundance.  A small patch of native milfoil was found in the northern corner of the lake.  Following a pre-treatment survey it was decided treatment was not necessary.  Total Phosphorus analyses collected during 2005 and 2008-2009 showed levels between 15 and 23 ppb, results for 2010 showed an elevation to 35ppb.  The total phosphorus should continue to be monitored to ensure the levels do not continue to increase.

  • Notice of a public hearing for National Grid for a project to upgrade overhead utility lines from Fenton Road to Hampden.
  • Various building permits.  

8:45  Leslie Duthie moved to adjourn.
