Conservation Commission Minutes 08/26/2009











MONSON CONSERVATION COMMISSION
MINUTES AUGUST 26, 2009

MEMBERS PRESENT:  Glenn Colburn, Leslie Duthie and Davis Johnson.

7:10   69 Lakeside Drive.  Donna Prybrylo attended the meeting in response to a letter sent by the Commission regarding a dock that has been built on her property.    

Leslie Duthie stated the Commission sent the letter because any work within 100 feet of a wetland requires a filing with the Conservation Commission.

Ms. Prybrylo stated she was not aware of that.  

Leslie Duthie stated the Commission is aware that many people do not know the regulations and are not aware that they have to file.  She recommended Ms. Prybrylo fill out a Request for Determination and return it to the Commission.

Glenn Colburn stated this was a project that the Commission would typically allow but there needed to be an official review with the proper paperwork.

7:30  100 Lakeside Drive.  The Commission received a letter from Nancy Bryant responding to correspondence sent by the Commission.  The Commission was made aware that the property owner was cutting trees in an area that may be within the jurisdiction of the Conservation Commission.

The Commission received a telephone call regarding the tree cutting and was informed the only trees that were removed were close to the existing house.

Leslie Duthie stated she looked at the site and if the only trees removed were by the house that would be outside of the 100 foot buffer zone.

7:40  Leslie Duthie stated she checked a house lot on Old Wales Road for Bill Lemon, Sr. and would sign off on the lot.  Mr. Lemon wants to clear the trees and that would be fine.  He left plans at the site and Ms. Duthie has left them at the office for him to pick up.

Glenn Colburn stated he checked a house lot on Hovey Road for Richard Royer and would sign off on the lot.   

Leslie Duthie stated she spoke with Don Frydryk about the Miller property on Hovey Road and the Notice of Intent that John Chaves was supposed to file for the earth removal.

MAIL

  • RFD Butler Road Annette Berube & Brian Stimson.  The Commission will set a site visit.
  • Old Stagecoach Drive, Elizabeth Chase recorded the Certificate of Compliance.
  • Letter from Massachusetts Historic re: Applicant for the grant for Cortina property.
  • Return receipt from Christopher Haley and Kevin Haley for certificate of compliance for property on Palmer Road.
  • Letter from Nancy Bryant 100 Lakeside Drive.
  • Letter from Dell & Cheri Bean, Boston Road regarding possible violations on property owned by Keith Bourbonnais.  The letter stated Mr. Bourbonnais is cutting trees within a wetland and they did not receive written notice for the work and assume that there has been no filing with the Commission.  
Leslie Duthie stated by the look of the photographs that accompanied Mr. Bean’s letter she would guess this is a violation but would check the site and prepare a letter for the Commission to send.  

  • Mass Wildlife.
  • Various Building permits.
The Commission set a site visit for Wednesday September 2, 2009 at approximately 4:30 to 4:45 P.M. for the Berube property on Butler Road.

Minutes Glenn Colburn moved to accept the minutes of August 5, 2009.                                                                                                                                                                                                                                              

Leslie Duthie seconded the motion.

It was so voted unanimous.

Leslie Duthie stated she walked the Cortina property with a woman from the EOEA and it went well.  Ms. Duthie stated the representative from EOEA was impressed with the property.  On paper she had some concerns because of the reference to the Town dump but was pleasantly surprised on visiting the property.

8:30 Leslie Duthie moved to adjourn.

Glenn Colburn seconded.

It was so voted unanimous.
