MONSON CONSERVATION COMMISSION
MINUTES 4/1/2009

MEMBERS PRESENT: Leslie Duthie, Glenn Colburn, Davis Johnson, Donald Lambert

MEMBERS ABSENT:

7:00  Jeff and Peter Kuselias came before the Conservation Commission to discuss lot #41 Carpenter Road, and to request an extension of the Order of Conditions for the construction of a single family house.  They have installed the silt fence, posted the DEP number, and staked the location of the house foundation.  The deed notation appeared adequate and was approved for use.  The original Order of Conditions for the house may not have been recorded by the previous owner of the property.  If so, the Kuselias’ will need to first record the original OOC before the commission can issue an extension.  It will be their responsibility to provide proof to the commission that the Order has been properly recorded.  Glenn Colburn signed the building permit.  The commission will wait for proof of recording before issuing an extension.

7:15  Jonathan Brodeur, 325 Main Street was before the commission for an informal discussion regarding restrictions on his property.  The lot is completely in the Riverfront Resource Area.  However, since the minor brook flowing adjacent to the foundation of his house was never mapped by the Army Corp., it is not shown on the towns flood plain maps as being in the flood plain of Chicopee Brook.  The Conservation Commission did emphasize that there is a flood plain associated with the small stream.  Mr. Brodeur was informed that he would need to file under the WPA for any grading or construction on his property.  This would include grading for surface drainage, or more extensive work for any sort of subsurface foundation drains.
        There was discussion about the health of the stream and what Mr. Brodeur felt was sedimentation coming from the motorcycle hill climb property.  The Conservation Commission explained our current dealings with the club in maintaining their erosion control structures.  All agreed that the recent flooding carried a great amount of silt down stream.  However, with the sandy nature of the local soils, there will always be a certain amount of gravel moving within the streambed.

7:30 David Mill, Wales Road appeared before the commission to discuss the lack of progress to remove the un-permitted bridge he constructed without permission on his neighbors property.  The OOC was issued on August 14, 2008 for removal of the bridge.  Mr. Mill had the Order recorded today, 4/1/09, before the meeting.  No work has been done since the Order was issued.  While the Order of Conditions does state that work shall be done at a time of low water flow, the commission told Mr. Mill that we would like the work completed soon.  Total time to complete the removal should be no more than a couple days.  Mr. Mill should monitor the flow and work quickly when the opportunity is there.
        Pictures Mr. Mill had recently taken of the bridge show no evidence of ORV traffic, contrary to reports received from the motorcycle hill climb.

Richard Courchesne, 83 Lakeside Drive, DEP #228-249 has requested an extension of his Order of Conditions for 18 additional months.  Reason for request is partial loss of funding for the work, combined with the current poor economy.  The commission voted to extend the Order of Conditions for an additional 18 months.

Lower Hampden Road Reconstruction Project – C&A Construction has informed the commission that they are preparing to resume work on the reconstruction of a section of Lower Hampden Road.  Work will start 3/30/09.  C&A will check all erosion control structures and turtle barriers. Reports will be submitted to the commission on a bi-weekly basis.

Minutes of the March 11th meeting were accepted without change.
