MONSON CONSERVATION COMMISSION
MINUTES 1.16.2008

MEMBERS PRESENT: Tom Faulkner, Davis Johnson, Glenn Colburn and Leslie Duthie

MEMBERS ABSENT: Donald Lambert

7:10 The Commission signed the bill schedule.

Leslie Duthie excused herself to avoid the appearance of a conflict.

Donald Frydryk stated before he reviewed the driveway design and drainage for Lot 1 Carpenter Road he wanted to relate to the Commission that all of the pins have been set on the property on Carpenter Road owned by Robert McCray and the Commission would receive a plan showing the property lines and numbering.  

7:20  NOI Lot 1 Carpenter Road McCray Realty.  Donald Frydryk stated the Notice of Intent for Lot 1 was filed a couple of years ago and has taken this long because all of the property on Carpenter Road owned by the McCray family was found to be actual habitat for the endangered box turtle.  That has now been resolved with Natural Heritage and the property owner is going to move forward with Lot 1.  The driveway has been designed through an easement up to a house lot.  The easement also allows access to Lot 4 for the mowing and maintenance of the nesting habitat compensation area.  .  The crossing is a bottomless culvert crossing.  The majority of the driveway is in fill but there is a cut section with a swale.  The drainage goes from the swale into a sediment basin with a rip rap spreader and then down into wetlands.  The rest of the driveway has a crown on it that will allow water to sheet flow off.  The driveway is flat down by Carpenter Road and there are no curbs.  Only the cut slope of the driveway has a swale.  

Glenn Colburn questioned what was happening with the sewer and water lines?

Donald Frydryk stated the utilities are going through easement and typically have 4-5 feet of cover.

Glenn Colburn stated it appeared not a lot of fill would be leaving the site.

Donald Frydryk stated a little under 1600 cubic yards of cut material would leave the site.

Glenn Colburn stated if he remembered correctly most of the drainage off of the driveway would sheet flow.

Donald Frydryk stated that was correct no closed drainage is proposed.

Leslie Duthie speaking as an abutter stated the soils are very sandy and fast draining in this area.

Donald Frydryk stated a tracking pad has been added at the entrance from the road.  

Glenn Colburn stated there is a small amount of grading work outside of the permanent work limit line but once the work is completed the area should be left alone to revegetate.  The Commission discussed reseeding this area with little blue stem.

Donald Frydryk stated the slopes are 2-1 through the cut area that was done to reduce the cut and fill amounts.  The slopes are not going to be maintained inside the deed restricted area so it may as well be that little blue stem should be used there also and then the area left alone.  

Leslie Duthie stated speaking as an abutter a lot of work has been done to protect the turtle habitat, as work is occurring in this area especially the stream corridor where there is a lot of multiflora rose she would like to propose that the Commission ask that the invasive species be removed.   The report from Mr. Richmond discounted this area as habitat because of the invasive species.

Donald Frydryk stated he did not know how the property owners would feel about removing the invasive species along the stream corridor but the Commission could include in its Order of Conditions that within the limit of work the invasive species shall be removed.

Glenn Colburn moved to close the hearing and issue an Order of Conditions...

Davis Johnson seconded the motion.

It was so voted unanimous.    

Leslie Duthie returned.

7:55 Leslie Duthie stated she had reviewed the material from the Attorney for Robert McCray and still had a couple of questions.  There seemed to be some confusion with regard to the selective cutting of trees in the nesting area and removal of invasive species.  The issue of enforceability has been addressed as requested by the Commission.

8:05 NOI Wales Road, David Mill.  Leslie Duthie moved to continue the hearing for Wales Road because NHESP has not responded additionally the snow cover makes it difficult to see anything.

Glenn Colburn seconded the motion.

It was so voted unanimous.

8:10  NOI Wilbraham Road Stephen Phillips.  Davis Johnson stated he checked the site after the rain but there was still snow on the ground.

Leslie Duthie moved to continue the hearing until the ground is clear.

Glenn Colburn seconded the motion.

MAIL

1.      Forest cutting Reimers Road, Quinlan.

2.      Copy of a notice of penalties and restoration levied by DEP against Tadeusz Bukowski, Palmer Road.

3.      DEP issued a file number for David Mill Wales Road DEP 228-312.

4.      NHESP responded to a Notice of Intent filed for Stephen Phillips, Wilbraham Road.  The project as proposed does not pose a threat to the habitat of endangered species.

5.      Letter from Town Counsel stating the deeds of property on Main Street and Town Farm Road transferred from the Monson Historical Society to the Conservation Commission were recorded.

6.      Moore Contractors received the Certificate of Compliance for Macomber Road.

7.      RFD William Fountain, Waid Road.

Leslie Duthie stated there is a driveway already on the lot and wetlands off of the south side of the property.  The Commission will schedule the meeting for January 30, 2008.

8:30 The Commission received a copy a legal notice from the Zoning Board of Appeals relating to earth removal on property owned by Raymond Miller on Hovey Road.  The Commission met with a member of Mr. Miller’s family sometime ago because it received notice of work occurring in wetlands without a permit.  At that time the Commission was told the property owner was removing junk metal and car parts that were in the swamp.  The Commission had no problem with this activity but made it clear any work within 100 feet of wetland would require a filing.  The Commission did not give Mr. Miller or any member of his family permission to remove earth material and was unaware that an earth removal operation was being conducted on the premises.  Chairman Leslie Duthie stated she would write a letter to the Zoning Board of Appeals in time for its meeting on January 24, 2008.

The Commission signed the Certificate of Compliance for Daniel Levesque 96 High Street.  The certificate was for work involving the stabilizing of steep slopes on property owned by Mr. Levesque and an abutter.

The Commissioners received notice of the MAAC Annual Conference in Worcester and will complete the forms for the workshops they want to attend.

8:45 Leslie Duthie moved to adjourn.

Glenn Colburn seconded the motion.
