MONSON CONSERVATION COMMISSION
MINUTES NOVEMBER 8, 2006

MEMBERS PRESENT:   Tom Faulkner, Leslie Duthie, Davis Johnson, Donald Lambert and Glenn Colburn.

7:15  ANOI Main Street, Clifford Holt.  Mr. Holt stated he wanted to remove an 8-foot by 23-foot wooden structure.  There is no foundation and the work would be done with hand tools.  A silt fence would be installed to protect the stream.  The wooden structure is located on the stream bank.  

Leslie Duthie stated the silt fence should be wrapped far enough around to protect the area.  

Clifford Holt questioned if hay bales would be needed?

Leslie Duthie stated in this case there is no excavation and it is not necessary to have both a both silt fence and haybales.  Once the building is removed plenty of mulch should be spread over the area.  

Clifford Holt stated there is a 4 or 5 inch lip and when the building is removed he would like to bring in loam and regrade the area.

Leslie Duthie stated the Commission prefers the area to be raked and smoothed out rather than bring in more material.

Leslie Duthie stated the Commission had not received a file number from DEP and would have to wait to receive that before it could close the hearing.

Leslie Duthie moved to continue the hearing to the next meeting.

Glenn Colburn seconded the motion.

It was so voted unanimous.

7:20 Leslie Duthie stated she wrote a letter to Chris Magill regarding the notification the Commission received of changes to his property. On checking the information on record there was a large wetland system and vernal pool on the site.  GIS shows that a pond has been created on the site and clearing has occurred within a resource area without filing with the Commission.  Ms. Duthie stated Chris Magill called her and as a result of the call the Commission will schedule a time to meet with him on his property.  

7:30  Grandview Terrace.  The Commission issued an Enforcement Order for work within the riverfront without any permits.

Eric Morin met with the Commission stating he recently purchased the property from Mrs. Pouliot and was trying to improve the access.

Leslie Duthie stated any work within 100 feet of a wetland and 200 feet of a stream requires a filing with Conservation Commission.   The Commission issued the enforcement order to stop the work immediately and file a Notice of Intent with the Commission.  The work is along the edge of the stream and the amount of material that has been moved around will adversely affect the stream and habitat.  The enforcement order also requires Mr. Morin to install silt fence immediately to protect the stream.   

Eric Morin stated he had completed all of the work next to the stream but would like to clean the tires and barrels out of the stream.

Leslie Duthie stated this type of work would not be allowed without a filing with the Commission.  She suggested the Commission meet Mr. Morin on the property to discuss what he had already done and what he wanted to do.

Eric Morin stated he had replaced the bridge decking to make it safe to walk over.

Leslie Duthie stated there is a garage with doors both front and back to allow access over the bridge.

Glenn Colburn stated the silt fence should be buried in about four inches at the bottom to keep material from washing into the stream.

Eric Morin stated he would put hay on the slopes to help keep the soil from eroding.

Leslie Duthie stated she looked at this property with Donald Frydryk and there is not a lot of vegetation.  The wetlands are across the street and down the street.  There are two obvious former access spots where the driveways are planned.  It will probably take the Commission awhile to walk the wetland lines and look at the ditch.   

Glenn Colburn questioned if there was a link from the wetlands across the street to the wetlands down beyond the Beaulieu property?

Leslie Duthie stated she questioned that but feels it drains the opposite way.  She stated when she first looked at the property she thought there was a connection but is not sure now.

The Commission signed the Order of Resource Delineation for property on Ayers Road Assessors map 122 Parcel 3A.  Confirmed as accurate by this delineation are:
Riverfront Resource Area. Mean Annual High Water Line HWM – 1 to HWM –30.  HWM 1 –30 and BVW line W 1 – W-24 EAST.

Wetland flags lines W-1 to W-9 WEST (BVW), HW-1 – HW-8 WEST (MAHW) and line A1 – A 12 (BVW) are NOT verified and not considered accurate by the Monson Conservation Commission.

The Commission signed the Order of Conditions for Michael Delisle Lot 8 Bennett Road.  The applicant must refer to the plan submitted for location of the 5 cement bounds and must provide a deed notation.  

The Commission signed the Order of Conditions for Dan Levesque 96 Main Street.  Only clean fill may be used, all disturbed slopes are to have a minimum of 12 inch modified rock fill as cited on the plan.  Maintenance of the armored slope is on going.  

The Commission signed the Order of Conditions for the restoration of the swale on Hospital Road.

8:50  Leslie Duthie stated she received notice that the Commissions’ application for a Self-Help Grant was not funded.

The Commission set site visits for Grandview Terrace, Eric Morin Thursday November 9, 2006 at 4:30 P.M., Silver Street, Christopher Magill Friday, November 17, 2006 at 4:00 P.M. if this is not convenient for Mr. Magill the alternate date is Sunday November 19, 2006.   A site visit was set for 229 Wales Road, Robert Cote, Sunday, November 19, 2006 at 8:00 A.M. and Carpenter Road, Andrew Beaulieu Sunday, November 19, 2006 at approximately 9:00 A.M.  

The next regularly scheduled meeting of the Commission falls on November 22, 2006 the day before Thanksgiving and following discussion it was clear that the Commission would be unable to meet its quorum requirements.

Leslie Duthie moved to cancel the next meeting and resume the regular schedule on December 6, 2006 at 7:00 P.M.

Glenn Colburn seconded the motion.

It was so voted unanimous.
